On May 12, 2023, at 10:26 AM, Licensing Program Analyst (LPA), Anastasia Flores, conducted an annual inspection as part of a compliance review. A tour of the inside and outside of the facility was granted and the following was observed and/or noted:

· The following items were posted and updated where necessary:
- License
- Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148)
- Parent’s Rights Poster (PUB393)
- Personal Rights (LIC613A)
- Child Car Seat Law
- Menu
· The facility is operating within the limits as stated on the license.
· Ratios are being met during this inspection
· Classrooms are adequately equipped with age and size appropriate furniture and equipment and free of hazards.
· There are no weapons present at the facility as stated by Jessica Compagnon
· There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· Public drinking water is utilized for the supply of drinking water in the indoor & outdoor activity space (drinking fountains, jugs filled daily with sink water and children use small cups) was observed
· No Medications are stored during time of inspection.
· Hazardous items are stored where inaccessible to children which include: Disinfectants, cleaning solutions and other items that are dangerous
· Poisons and toxins are locked and inaccessible to children
· All floors were observed to be clean and safe

LPA was informed the drills are conducted once a month, teachers were unaware where the carbon monoxide detectors or smoke alarms were in order to be tested, Ms. Jessica called Director Liz Tresler she could not inform Ms. JEssica where the drill log was at the time. Licensee will conduct an emergency drill and send LPA Flores a copy of the drill log by 5/19/23 via email.

LPA Flores asked teacher Jessica, how often the playground is cleaned or checked for cobwebs, she stated at least once a week we attempt to clean, dust off the areas.

Licensee will have the yard cleaned, take photos and ensure the staff are keeping the yard daily prior to being utilized by children in care. Licensee will send LPA Flores via email a photo of the yard cleaned and also a plan of correction letter to ensure the playground and toys will be maintained and cleaned prior to use by children in care by 5/19/23 via email.

Based on LPA's observation, the licensee did not comply with the section cited above; there was a clear plastic rectangular storage container, open with an estimate of 3 inches of water that appears to have been sitting with blocks/legos sitting for a long period of time. The area was not an area the children normally play in but is not safely blocked off to make the area inaccessible to children in care. This posed a potential health, safety or personal rights risk to persons in care.

·Bathrooms were observed to be safe, sanitary and in operating condition (water faucets in 2-year-old classroom water pressure is very low)
· Playgrounds are enclosed by appropriate fences and free of hazards
· Outdoor activity areas are supplied with age and size appropriate equipment in good condition (deficiency for cleanliness)
· Food preparation area is clean, free of litter, rubbish and free of rodents and other vermin
· Food is stored appropriately and protected from contamination
· All storage containers for solid waste, including moveable bins shall have tight-fitting covers that are kept on, and in good repair
· Sign in/Sign out record was reviewed and meets regulation requirements
· Disaster drills to be conducted every six months – last drill conducted is unknown (deficiency given)

A review of staff and children's records were conducted as part of this evaluation.
· Children’s records were found to be complete during this inspection.
· Staff records review indicates that all staff present meet minimum qualifications for the position for which they were hired.
· A Staff member is present with current Pediatric CPR/First Aid which expires on 4/2024
· Opening and closing staff member’s CPR/First Aid expires on 4/30/2024
· Director completed Health and Safety Training
· A review of staff records on 5/12/23, indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. · Menus shall be posted at least one week in advance in a place visible by the child’s authorized representative, dated and kept on file for 30 days, and made available upon request.

·The areas around or under high climbing equipment, swings, slides, and similar equipment shall be cushioned with material that absorbs a fall

Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
