32 | On March 5, 2026, LPA Morris arrived at the facility and conducted interviews with the licensee and children in care. During the inspection, LPA Morris observed the licensee and assistant staff checking diapers and completing diaper changes. Licensee Gutierrez reported that diaper changes are completed as needed. She stated that if staff observe a child using the restroom or notice an odor, they check and change the child’s diaper accordingly. However, LPA Morris was unable to verify this information because the facility does not maintain diapering logs. LPA Morris also attempted to obtain additional pertinent information but was unable to identify specific dates or details related to the alleged diapering issue. Licensee Gutierrez further stated that diapers are checked every one to two hours in the FCCH. The licensee denies the allegations.
Based on LPA’s observations, files reviewed, and interviews conducted, the allegation licensee left infant in soiled diaper for an excessive amount of time is unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
Regarding the allegation that the licensee uses corporal punishment in the presence of daycare children, LPA Morris conducted interviews with staff, children in care, and parents. Confidential interviews with children did not reveal any evidence that the licensee or assistant staff use corporal punishment at the daycare. Parents interviewed reported that they have never witnessed the licensee or staff behaving aggressively or using physical discipline toward children at the facility. Additionally, LPA Morris did not obtain any video or photographic evidence to support the allegation, and there is no physical evidence available for review. All staff interviewed denied the allegation, and no disclosures were made during interviews to support the allegation.
Based on information obtained through interviews with the licensee and other relevant individuals, the above allegations cannot be verified. While the allegations may have occurred, there is insufficient evidence to determine whether they did or did not take place. Therefore, the allegations are UNSUBSTANTIATED.
Exit interview was conducted and report was reviewed by Licensee Angelica Gutierrez. A notice of site visit was given to licensee and must remain posted on, or immediately adjacent to the interior side of the main door for 30 days. The report must be made available to the public for three years. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
