32 | interviews conducted by Riverside County Sheriff's Department (RCSD) with C1 and child resident #1 (CR1). Investigator Iniquez of the RCSD informed parents of other enrollees of the daycare of the investigation and offered for their children to be forensically interviewed. Of the children interviewed, there were no additional disclosures of inappropriate touching at the daycare. Per the forensic interview with C1, it
was confirmed that CR1 inappropriately touched C1s private area and told C1 not to tell anyone. During
the interview C1 was shown a photograph and was able to identify the perpetrator as CR1. The interview
conducted with licensee revealed that CR1 and C1 were together inside the home during the time of
incident, while licensee and other children were outside playing.
Based upon interviews with pertinent parties, the Department has determined the preponderance of
evidence standard has been met, therefore the allegations are found to be SUBSTANTIATED. See LIC
9099D (page 3) for deficiency cited per California Code of Regulations, Title 22, Division 12.
Enhanced Civil Penalties (ECP's) of $2000.00 are being assessed by the Department for violations
surrounding the substantiated sexual abuse allegation. The ECPs were discussed with the Licensee during
the inspection and Licensee was advised that an invoice will be forthcoming in the mail and will be due
upon receipt. The Licensee was advised to not send payment until such invoice is received by the
Department.
LPA Sanchez informed Licensee Elizabeth Ortiz, this report, dated 8/28/2023, documents one Type A citation, which shall be posted for 30 consecutive days as there is immediate risk to the health and safety of children in care. Also, LPA informed the Licensee to provide a copy of this licensing report dated 8/28/2023, which documents a Type A citation, to parents/guardians of all children currently enrolled by either the next business day, or the next day the children are in care. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was conducted, and a copy of this report was reviewed with and provided to the
Licensee Elizabeth Ortiz, along with appeal rights. |
