32 | LPA investigated the allegation and gathered the following information:
It was reported, facility is operating out of capacity and facility is not maintained clean and sanitary.
LPAs observed toys trailing from the front entrance to the back of the home. LPAs also noticed the tiles on the floor were full of debris, food crumbs, droppings that had dried up due to not being cleaned up. Surfaces of the home like the desk in the daycare area and counter top in the kitchen, coffee table in the living room were all full and cluttered with numerous items like: books, loose papers, dirty dishes, used towels, uneaten food and other items. In the backyard in the area where children play, it was found to be cluttered and dog feces were also not cleaned up and exposed to the children's' playing area.
LPAs also observed 10 children in care (one picked up during visit), in addition to the licensees own child who is over the age of 10 and resides in the home. Licensee also shared that she was unaware that a 12 year old who was present during the visit would count as a daycare child. This put the daycare over ratio by two children.
Based on LPA interviews and observations, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC9099D.
An exit interview was conducted with the director, Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site visit was issued. Upon receipt of this report, the Licensee shall post the Notice of Site Visit and any Licensing report documenting a type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty.
A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement of Receipt (LIC 9224 form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the Acknowledgement of Receipt of Licensing Reports (LIC 9224).
A copy of this report must be made available upon request for the next three years. |
