32 | The Licensing Program Analyst (LPA) Samuel Lopez investigated the above allegations and gathered the following information: On 5/4/2022 the facility had a total of three employees on site, in addition to the licensee. However, not all were present during the time the children were napping, due to some staff having their lunch time scheduled at the same time, and licensee leaving to pick up their child from school. According to the facility schedule, nap time ranges from 12:45pm to 2:30pm. During nap time, one staff clocked out for lunch at 12:37pm and back in at 1:55pm another left at 1:37pm and returned at 2:54pm. These time frames were verified by staff and their timecards also coincide. Based on the times, from 1:37pm to 1:54pm, there was only one staff present to provide supervision to the children while they napped. When another staff arrived from lunch at 1:55pm, they could not gain access to the facility, due to the door being locked. The lone staff that was providing supervision to the napping children walked out of the classroom, leaving the children alone and without supervision, to open the door. Staff returning from lunch was not aware, at that date and time, that the door near the playground, is kept unlocked. On the previous inspection (5/10/2022), LPA Phillips was outdoors on the playground and tried to enter the facility through the door that is to remain unlocked for staff to enter facility however, the door was locked an the LPA needed someone to open the door from the inside in order to re-enter the facility.
Based on interviews conducted, facility documentation, and additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation regarding children being left unattended, is found to be Substantiated.

LPAs Lopez and Giese informed licensee Manzar Farooqui and Director Mary Gallegos that this report dated May 26, 2022 document(s) a Type A citation, which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
