On 04/20/2023 at time listed above Licensing Program Analysts (LPAs) Giese and Sharma conducted an unannounced visit to the facility for another purpose. LPAs met with Licensee, Manzar Farooqui.

LPA's took census of children present and toured the facility inside and out. The following was observed and discussed with Licensee.

At 10:05am LPA's observed Facility's required postings and noted PUB393, Child Care Center Notification of Parents' Rights Poster, was not present. LPA's observed form LIC995, Child Care Center Notification of Parents' Rights posted, however; Licensing Regional Office address and information was not listed on the form. The Facility was found to be in violation of the following Title 22 Regulation:

101218.1 Admission Procedures and Parental and Authorized Representative's Rights
(c) The licensee shall post the PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster in a prominent, publicly accessible area in the child care center at all times. SEE LIC809D for Type B Deficiency

While taking Census of children present in the 2's program, "Green Room", LPAs observed a school age child present. LPAs identified the child's age to exceed the terms of the Facility's preschool License. Facility's preschool license states
"...CHILDREN. AGES 2 THROUGH 4. IN ROOMS GREEN (TWOS), BLUE (THREE/FOUR), PURPLE (FOUR)..." The Facility was found to be in violation of the following Title 22 Regulation:

101161 - Limitations on Capacity
(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. SEE LIC809D for Type A Deficiency

Pertaining to another matter, LPAs reviewed children's files. LPAs observed one file reviewed to contain the information for two separate children. The Facility was found to be in violation of the following Title 22 Regulation: SEE LIC809D for Type B Deficiency

(a) A separate, complete and current record for each child is maintained in the child care center.

An exit interview was conducted, A copy of this report and appeal rights were given to the Licensee during this inspection on 04/20/2023.

LPA issued a Notice of Site Visit and verified it was posted in a prominent location at the facility. Licensee understands that the Notice of Site Visit must remain posted for the next 30 days along with a copy of all Type A deficiencies cited during this inspection. A copy of all Type A deficiencies cited during this inspection must also be immediately (within 24 hours of child’s next day in care) given to the parents of all children enrolled in the child care facility and any children enrolled into the child care facility over the next 12 months (at the time of enrollment). Licensees are required to have all parents sign and date the Acknowledgement of Receipt of Licensing Reports (LIC9224) and maintain a copy in each child’s file. A copy of this report, LIC9224 and Appeal Rights (LIC9058) were provided during this inspection.
