25 | On the date and time listed above, Licensing Program Analysts (LPAs) Jeanette Sanchez and Lorena Valenzuela arrived at the facility to conduct a case management visit. On 4/12/2023, the department received an Unusual Incident Report (UIR) regarding an incident on 4/12/2023 at 11:10am, in which a child bit another child on the back, leaving a "purple mark" and breaking skin. LPAs met with Director America Figueroa.
LPAs interviewed staff directly involved in the incident, reviewed children records and toured facility. At the time of the incident, three staff were supervising 15 children in the outside play area. Two staff were sitting on the ground with children while one staff was standing, observing children. Interviews disclosed that staff were not actively supervising children and have not received any training on how to manage biting behaviors. Per Director, the incident resulted in a staff meeting during which staff watched the video and had to document what errors were made.
LPA Sanchez observed several children files had "bite" reports. One child referenced in the UIR had two bite incidents. The UIR incident was not noted on a "bite" report. LPA asked Director about the unacceptable behavior policy which states a third strike results in immediate dismissal. Director said she was unaware that the child had received the third strike.
Based on interviews and record review, LPAs determined that the child care center did not operate in accordance with the terms specified in the plan of operation, specifically the unacceptable behavior policy.

Exit interview conducted and report was reviewed with the licensee America Figueroa. A notice of site visit was given and must remain posted for 30 days. |
