On the above date and time Licensing Program Analyst (LPAs) Susan Brewer and Laura Mejorado arrived at the facility to continue an investigation into the above allegations and to deliver findings. The LPAs met with the met with the facility Director Desiree Ware. At 9:45 AM Program Director Marissa Jaimes-Enriquez, arrived to join the investigation. The LPAs conducted a census of 3 staff supervsing 6 children in the toddler option program, and 23 children supervised by 7 staff in the preschool program. The LPAs exited the facility from 12:30 to 1:30 PM.

On 01/07/2026, LPA Laura Mejorado initiated the investigation. On 01/15/2026 and 02/25/2026, follow-up investigations were conducted by LPA Susan Brewer. On today's date, the LPAs met with the directors to discuss the allegations. The LPAs made observations, conducted interviews and reviewed records which revealed the following.

It was alleged that staff are not following reporting requirements. LPAs interviews with pertinent parties revealed that on 12/11/2025 a subject staff was reported for the rough handling of two daycare children. Information gathered through record reviews and interviews with pertinent parties revealed local law enforcement made contact with the agency as a follow-up to one incident. Interviews with pertinent parties also stated on the same date a subject child was left unattended on the playground. On 12/12/2025 the licensee self-reported incidents of rough handling involving a subject staff and two children. However, the agency failed to include reports of information received 12/11/2025, regarding the rough handling of a third child, a child left unsupervised on the playground, a change in the new designated director, and contact with local law enforcement following one of the reported incidents of rough handling by a staff.

Although the agency self-reported two incidents of rough handling by a subject staff, the agency was unable to provide proof that the authorized representatives were notified of the alleged incidents involving a subject staff rough handling children. Based on the evidence gathered through observations, review of records and interviews conducted, the allegation is determined to be substantiated.

It was alleged that alleged that a child was left unattended at the facility. Information gathered through observations, facility records and interviews with pertinent parties revealed on 12/11/2025 a subject child was found playing on the preschool playground without supervision. Relevant witnesses stated it was unknown how long the child was left unattended before the facility representatives were notified of the subject child’s status. Based on the evidence gathered through observations, review of records and interviews conducted, the allegation is determined to be substantiated.

It was alleged that a facility staff handled children in a rough manner: Information gathered through interviews with pertinent parties, facility records, and video footage from 12/11/2025 revealed a subject staff was observed holding a subject child down and causing the child to squirm. Other relevant witnesses stated they observed the subject staff repeatedly grab the subject child inappropriately causing the child to scream and cry. Relevant witnesses indicated the same subject staff was observed grabbing a 2nd child, which resulted in contact with local law enforcement. Pertinent parties interviewed stated on 12/11/2025 a 3rd subject child alleged the same subject staff inappropriately grabbed the 3rd subject child. Based on the evidence gathered through observations, review of records and interviews conducted, the allegation is determined to be substantiated.

Based on LPA’s observations and interviews which were conducted and reviews, the preponderance of evidence standard has been met, therefore the above allegations that the facility is not following reporting requirements, that a child was left unattended and that a staff handled children in a rough manner, are found to be SUBSTANTIATED. California Code of Regulations, Title 22, divisions, 101212(d)(1) Reporting Requirements, 101229(d)(1), Reporting Requirements 101229(f), Responsibility for Providing Care and Supervision 101229(a)(1) and Personal Rights 101223(a)(3) are being cited on the attached LIC9099D pages.

If a Civil Penalty has been assessed during this inspection. Payment is due when billed and the check(s) or money orders shall be made payable to the “California Department of Social Services”. YOU WILL RECEIVE AN INVOICE IN THE MAIL. DO NOT SEND MONEY UNTIL YOU RECEIVE YOUR INVOICE. DO NOT SEND CASH.

LPAs Susan Brewer and Laura Mejorado informed Program Director Marissa Jaimes-Enriquez ,that this report LIC9099D dated 03/10/2026 documents 2 of Type A citation, which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPAs Susan Brewer and Laura Mejorado informed the Program Director Marissa Jaimes-Enriquez, to provide a copy of this licensing report dated 03/10/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

2 Type B deficiencies were issued on today's date.

A civil penalty was issued in the amount of $500.00.

A notice of site visit was given and must remain posted for 30 days.

It was alleged that the facility is operating with Inadequate staffing-out of ratio in the toddler option program and preschool program during the month of December 2025. The LPAs gathered information through observations, records reviewed and interviews conducted with pertinent parties revealed that during the month of December 2025, unqualified subject staff were left alone to supervise children in the toddler option program. In addition, pertinent parties stated a fully qualified teacher was not present to supervise. Other relevant parties interviewed stated that subject staff were left alone in with toddler operation children but were unable to provide dates. Pertinent parties stated preschool children were left alone with unqualified staff for a few minutes and fully qualified staff were absent from the classroom. However, the parties were unable to provide specified dates and times of the alleged incidents. Additional parties interviewed denied the allegation that unqualified staff are left alone to supervise daycare children. The licensee was unable to provide records of dates and times of staff assignments in classrooms, assigned locations and duties assigned. Based on conflicting evidence gathered, the allegation is unsubstantiated.

It was alleged that the facility operated with unqualified staff assigned in the toddler option program during the month of December 2025. The LPAs made observations, reviewed records and conducted interviews with pertinent parties which revealed that the agency was unable to provide documentation of staff assignments to cover shifts in the toddler option programs or preschool programs during operation hours. The LPAs reviewed records of permanent and substitute staff for qualifications which indicated the agency utilizes staff from other agency locations, due to the needs of the program. However, the agency was unable to provide records of dates and times of staff assignments in classrooms, assigned locations and duties assigned. Therefore, LPAs were unable to verify if qualified staff were assigned to each program during operation hours. Based on conflicting evidence gathered, the allegation is unsubstantiated.

Although the allegations of Inadequate Staffing-out of ratio and unqualified staff may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED.



No deficiencies were issued for these allegations.
