Licensing Program Analyst (LPA) Samuel Lopez arrived at the facility to conduct an inspection regarding a complaint received concerning the above allegation(s). LPA was given access to the facility by the Director Rosemary Torres and toured the facility. LPA met with Rosemary Torres to further discuss the complaint/allegations. Previously, on 12/2/2025, an inspection was conducted regarding the complaint, on that visit, interviews were conducted, and facility files were reviewed.

Facility hours of operation aren't true to what they state. Facility closes earlier than 6:00pm. Staff have informed parent/legal guardians that facility closes at 5:30pm because staff have families at home and there are not many children at the facility.

The Licensing Program Analyst (LPA) Samuel Lopez investigated the above allegations and gathered the following information: According to the facility parent handbook/admission agreement and facility license, the facility’s days and hours of operation are Monday through Friday, 6:30am to 6:00pm.

This is also reflected on the facility’s website page (itsalittlescholar.org). Per the facility Director/Site Supervisor, the facility operates during the days and hours as listed on the website and written in their parent handbook/admission agreement. However, LPA obtained information that, parent(s)/legal guardian(s), have been informed that the facility closes at 5:30pm. Also obtained information that the facility closes or has closed at various times earlier than 6:00pm, which include 5:30pm, 5:40pm, and 5:45pm.

Based on interviews conducted, documentation/reports reviewed, and additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensing Program Analyst (LPA) Samuel Lopez arrived at the facility to conduct an inspection regarding a complaint received concerning the above allegation(s). LPA was given access to the facility by the Director Rosemary Torres and toured the facility. LPA met with Rosemary Torres to further discuss the complaint/allegations. Previously, on 12/2/2025, an inspection was conducted regarding the complaint, on that visit, interviews were conducted, and facility files were reviewed.

The following was alleged: A staff member was observed yelling at a child in care and a child throwing something at the staff. A child’s costume was lost at the facility, and staff could not locate it.

The Licensing Program Analyst (LPA) Samuel Lopez investigated the above allegations and gathered the following information: Staff have raised their voices to address a child(ren) and avoiding them from hurting themselves or other children. Voices are not raised by staff for purposes of discipline. Some staff have been observed to naturally speak louder than others and may have to raise their voices due to the noise level at the facility.

On October 31, 2025, a child was dropped off at the facility wearing a Halloween costume however, upon being picked up at the end of the day, the child was no longer wearing the costume. Initially, staff were unaware of how or when the child removed their costume and could not locate it. A message was sent, via Brightwheel application, to all parents/legal guardians of children that had picked up their children on that day. The costume was not found on that day. It was later determined that the facility Director had removed the costume from and placed it in another child’s backpack/cubby. The following week, on a Monday, the costume was returned by another parent/legal guardian and reimbursement was issued.

Based on the information obtained, and although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated.
