On November 2, 2022 at 2:00 pm, Licensing Program Analyst (LPA) Jessica Rubio arrived unannounced to the Together We Grow (CCC), and met with Director (AD) Anna Garcia to deliver the investigative finding for the above stated allegation. During the investigation, confidential interviews were conducted with AD, and three staff (S1, S3, S5). LPA also obtained copies of pertinent records that included: children’s injury reports and timecards for staff and children.

On September 16, 2022, a complaint was received alleging staff did not allow responsible party (P1) of child (C2) to enter facility.

Confidential interviews conducted revealed C2’s last day attending the facility was 9/15/2022 and when P1 arrived to pick C2 up, P1 was told by staff that C2 would be brought out to P1, while P1 remained in the lobby entrance. Additionally, interviews revealed it was common practice for parents or responsible parties to enter into the facility past the lobby and pick up their children from their classroom. Interviews revealed P1 had previously and usually did this, however on 9/15/2022, C2 was brought out to P1. Interviews also revealed that at the time of pick up, P1 was not acting in an aggressive or threatening manner that would have warranted staff not letting P1 enter the facility.

Based on confidential interviews, the preponderance of evidence standard has been met. The department has determined the allegation that staff did not allow responsible party, P1 of C2 to enter facility is substantiated. The facility is being cited for violation of the California Code of Regulations Title 22 Section 101218.1 (b)(1) Admission Procedures and Parental and Authorized Representative's Rights.

An exit interview was conducted and a copy of this report, LIC 811 and appeal rights was provided to Director Anna Garcia. A notice of site visit was also provided and must remain posted for 30 days.

On September 16, 2022, a complaint was received alleging lack of supervision resulting in child sustaining injuries, specifically C2 sustaining multiple bruises on their legs and a scratch on their neck while attending CCC.

Confidential interviews revealed that C2 attended the CCC from November 2021 through September 15, 2022. Record review revealed that C2 received three “Ouch” (injury) reports. One dated 3/9/2022 in which C2 was scratched on the neck by another child, one dated 5/13/2022 in which another child pulled toys down from a shelf causing toys to fall on C2’s hand and arm and, one dated 5/31/2022 in which C2 had been bit on the arm by another child. Interviews and record review revealed during the incidents the classroom had approximately 4-7 children in the class with a teacher providing care and supervision.

Based on confidential interviews and record review, the allegation that lack of supervision resulted in C2 sustaining injuries may have occurred, however is not supported or proven by evidence. Therefore, the above allegation is unsubstantiated. A copy of this report, LIC 811 Confidential Names List and appeal rights were given and explained to Director Anna Garcia. A notice of site visit was also provided and must remain posted for 30 days.
