32 | Regarding the allegation that licensee is operating out of ratio, confidential interviews revealed that A1 is currently the assistant for the FCCH, however A1 has also obtained employment elsewhere. A1’s employment gives A1 the ability to work from the FCCH and A1 does not have a set schedule. Another interview revealed that A1 is upstairs in the FCCH or not present to supervise children due to working another job. Interviews with licensee and A1 revealed A1 is present when needed to be included in the ratio and does occasionally make phone calls or attend virtual meetings when A1 is not needed to be in ratio or when children are napping. Both licensee and A1 revealed that licensee has not been left alone if more than eight children were present. Interviews with children further revealed that LIC and A1 take care of the children and A1 does leave the FCCH sometimes, while licensee never leaves. LPA reviewed the roster and it appeared fourteen children were enrolled, however license stated it had not been updated and there are only ten children including her own school age child who are enrolled at this time. Furthermore, on 8/16/2023, when LPA arrived to the FCCH, LPA observed there were seven children present with licensee providing care. A1 was not present in the facility when LPA arrived, however, A1 did arrive within 15 minutes of LPA arriving. An eighth child later arrived and although due to the census, A1 was not required to be in ratio, A1 assisted licensee in the facility the remainder of the time LPA was present. Interviews also revealed that A1 was present prior to LPA arriving that day.
Regarding the allegation that licensee did not prevent children from hitting other children in care, confidential interviews revealed that C6 and C1 got along and played together often, while another interview revealed C6 hit C1 often and C2 was hit by another child. All interviews revealed if children are hitting, the licensee does speak to the children, tells them not to hit and to keep their hands to themselves.
Based on conflicting statements, the allegations that licensee is operating over ratio and licensee did not prevent children from hitting other children in care, may have occurred, however are not supported or proven by evidence. Therefore, the above allegations are unsubstantiated. A copy of this report, LIC 811 Confidential Names List and appeal rights were given and explained to Licensee Ilse Juhl. A notice of site visit was also provided and must remain posted for 30 days. |
