On December 5, 2025, at 12:18 P.M., Licensing Program Analyst (LPA) Courtnee Peebles met with RCOE – Las Brisas Child Development Center (CCC) Cynthia Zuniga, Program Development Specialist to deliver findings regarding the allegations under investigation. As part of the investigation, LPA Peebles conducted interviews with four staff members (D–S3), one child (C1), and one witness. A health and safety inspection of the CCC was also conducted on September 16, 2025, during which no safety concerns were noted, and pertinent documentation was obtained and reviewed.

On September 12, 2025, Community Care Licensing (CCL) received information alleging that staff pinched a child and handled children in a rough manner. Regarding the allegation of pinching, it was reported that S3 pinched a daycare child while attempting to return the child to the classroom after the child ran out. Confidential interviews provided conflicting accounts: some indicated that the staff member was never observed pinching any child, while others disclosed that S3 did not deny pinching C1 and appeared upset with the child on the day of the alleged incident. small red mark above the armpit where the child stated they were pinched; however, there is no definitive evidence to prove S3 pinched the child.

Regarding the allegation that staff handled children in a rough manner, confidential interviews revealed that on the date of the alleged incident S3 was heard yelling in the classroom, although it was unclear whether S3 was yelling to gain children’s attention or if S3 was yelling out of frustration. Staff also reported receiving multiple trainings on redirection techniques and strategies to help children calm down.

Based on the information obtained, it was determined that although the allegations may have occurred or appear credible, there is not a preponderance of evidence to prove that the violations did or did not take place. Therefore, the allegations that staff pinched a child and staff handled a child in a rough manner are all deemed unsubstantiated.

An exit interview was conducted with Cynthia Zuniga, Program Development Specialist, during which the report was reviewed and a copy provided. Appeal rights were discussed and issued at the time of the exit interview.

A Notice of Site Visit was also issued and must remain posted for 30 consecutive days in a location visible to the public.
