32 | Additional allegations were received, that facility staff force fed children in care and facility staff yell at children in care. Confidential interviews disclosed that on at least one occasion S2 was observed, making a child eat a bite of a muffin prior to leaving the table. Other confidential interviews revealed that during breakfast time, S2 placed her hand over a child’s hand child #2 (C2) placing a piece of cereal in the child’s mouth. Interview with S2 denied force feeding a child at any time. Other confidential interviews deny observing this sort of incident occurring. It was reported that S2 will yell at children to stop crying, when they are upset. Confidential interviews disclosed that S2 is aggressive with the children in the tone of voice utilized. Interview with S2 denied allegations of yelling at children in care unless they are going to harm themselves with incident such as going down the slide wrong, S2 would yell, “Stop.” Other confidential interviews disclosed no observation of S2 yelling at children in care.
An additional allegation was received that facility staff are not following day care child’s IEP plan. It was reported that the IEP goals for children in care are not being worked on and the students are not receiving the proper support. Confidential interviews disclosed that S2 will often be on the tablet when S2 is supposed to be engaging with the children. Other confidential interviews revealed, S2 does work with the children and talks with them at the tables. Interview with S2 denied not working with the children on IEP’s and the role of being in the inclusion class is to assist with the children on IEP’s.
Based on the information obtained during this investigation, it has been determined that although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur. Therefore, the allegations that facility staff handled day care child in a rough manner, facility staff force fed a child in care, facility staff yell at children in care and facility staff are not following day care child’s IEP plan are UNSUBSTANTIATED.
An exit interview was conducted, and this report was reviewed with the Site Supervisor, Star Monville, and a copy was provided. Appeal rights were discussed and provided during the exit interview.
A Notice of Site visit was given, and Director understands that it must remain posted for 30 days. |
