With respect to the allegation that staff did not ensure personnel records were maintained, interviews and a review of personnel records showed that substitute staff apply through an online recruitment process, are screened by a recruiter, and are then referred to the facility director for further review. Although concerns were raised about ensuring all required documentation and qualifications were obtained, the investigation did not produce sufficient evidence to establish that personnel records were not maintained in accordance with regulatory requirements.
Regarding the allegation that staff yell at day care children, interviews indicated that staff may, at times, use a firm or stern tone when redirecting children’s behavior. Documentation showed that the facility is aware of this concern and has provided ongoing coaching and training to staff emphasizing calm, appropriate communication with children.
Based on conflicting statements and the absence of corroborating evidence, there is insufficient information to determine that untrained staff provided care, that personnel records were not maintained, or that staff yelled at day care children. Therefore, the allegations are unsubstantiated. An unsubstantiated finding means that, although the allegations may have occurred or may be valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur.
An exit interview was conducted, and a copy of this report, the Appeal Rights, and a Notice of Site Visit were provided to Director Zinnia Gutierrez. The Notice of Site Visit must remain posted in a prominent location visible to families and caregivers for 30 consecutive days. |
