There is an in-ground pool with a 5 feet wrought iron fence that has two access self-close and self-latch doors. The lock of the fence is 60in above the ground. There is no pool alarm and pool daily log. There is a 10ft adjustable rescue pole and a 20in. life ring approved by United States Coast Guard. LPA reviewed with licensee, Alberta Lua, of the new pool regulations that passed on 2025 and provided a copy of the most up to date pool regulations to ensure compliance during business hours and whenever there are children under her care. Licensee will ensure compliance by the POC date on 809-D page. In addition, all wading pools or similar products must be emptied immediately after use and stored in an upright position.
LPA did not observe that a daily pool inspection log being completed on days of operation to ensure all safety measures are in place.
Both children's and employees' records are complete. Mandated Reporter Training has been completed and is valid until February 05, 2027. The Pediatric CPR and First Aid certification expires on March 31, 2028. Resident and staff records were reviewed, and all adults requiring caregiver background checks have received the necessary clearances and exemptions.
Licensee Alberta Lua was reminded that all adults 18 and over, living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
LPA discussed the safe sleep regulations with Licensee Alberta Lua and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
