On June 18, 2024, at 09:31 AM, Licensing Program Analyst (LPA) Courtnee Peebles arrived unannounced to FRYE, DESTINY FAMILY CHILD CARE (FCCH) and met with licensee, Destiny Frye to close an investigation based on the allegations above. On June 17, 2024 at 09:31 AM, LPA conducted a tour and census of the FCCH. During the investigation, LPA conducted confidential interviews with three staff (LIC), (S1), (S2), two parents (P1), (P2) and one Adult (A1).

On May 14, 2024, a complaint was received with allegations stating, Licensee is not meeting day care child's diapering needs, Licensee does not prevent access to the staircase from day care children. Regarding allegation Licensee is not meeting day care child's diapering needs. Based on interviews with parents three of three interviews disclosed they do not provide as many diapers as they should to the FCCH. Interviews also disclosed on several occasions children’s diapers have been soiled when children are picked up from the FCCH.

Three of Three interviews revealed the FCCH is open from 08:00 AM to 04:00 PM and infants are changed 2-3 times daily or when staff see and smell a full diaper. Regarding allegation, Licensee does not prevent access to the staircase from day care children. Based on observation on 05/23/2024 and interviews licensee has not had a barricade preventing access to the second floor. Interviews revealed, children may have gone up the stairs and are stopped halfway and immediately brought back down to the first floor.

Based on interviews conducted and observation, the allegations the preponderance of evidence standard has been met. Therefore, the above allegations Licensee is not meeting day care child's diapering needs, Licensee does not prevent access to the staircase from day care children are found to be SUBSTANTIATED.

An exit interview was conducted and copy of this report, appeal rights and Notice of Site Visit were provided to licensee Destiny Frye. Licensee was reminded that the Notice of Site Visit must be posted in the facility in a visible area for 30 days.

102423 Personal Rights
(a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:
(4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning.

Licensee will begin documenting daily diaper changes for each infant in care. Proof will be provided to LPA via email.

Based on confidential interviews 2 of 2 interviews disclosed children were picked up in soiled diapers and parents are not providing diapers as often as they probably should. Interviews also revealed P2's infant came home often with rashes which improved once the infant was removed from LICs care. This poses a potential health, safety or personal rights risk to persons in care.

(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to:

On 05/23/2024 LPA's observed the staircase to be accessible to children in care. Licensee has since placed a proper barricaded preventing access to the second floor.
