On June 18, 2026, at 11:17 AM, Licensing Program Analyst (LPA) Courtnee Peebles arrived unannounced at Frye Family Child Care Home (FCCH) and met with Licensee Destiny Frye to conclude the investigation regarding the allegations listed above. During the visit, 8 children were present, and the Licensee reported that 14 children are enrolled.

The investigation was initiated following a complaint received on April 17, 2026, alleging that the Licensee inappropriately disciplined day care children and that the facility operated out of ratio. Interviews and other evidence revealed that when children exhibited challenging or unwanted behavior, staff, under the authorization of the Licensee, used a high chair as a means of behavioral control. Additional interviews indicated that the high chair was used in response to misbehavior rather than solely for feeding or age appropriate seating. Staff statements further confirmed that children were placed in the high chair for periods of time as a corrective measure.

Regarding the allegation that the facility operated out of ratio, interviews and evidence revealed concerns about staffing levels during afternoon pick up hours. Evidence indicated that during this time, one staff member would leave the facility to pick up school aged children, leaving one assistant to supervise more than eight children. Interviews further revealed that during these periods, the Licensee was typically located upstairs, where the entire second floor is off limits, and was not consistently available in the accessible on limits areas to assist with supervision or maintain required staffing ratios. This staffing arrangement resulted in instances where the number of children present exceeded the allowable child to staff ratio for the qualified staff member on site.

Based on LPA observations, interviews conducted and a review of records, the preponderance of evidence standard has been met. Therefore, the above allegations are found to be substantiated. Citations are documented on the attached LIC 9099D.

An exit interview was conducted, and a copy of this report, the appeal rights, and the Notice of Site Visit were provided to Licensee Destiny Frye. The Licensee was reminded that the Notice of Site Visit must be posted in a prominent location within the facility for 30 days.

Licensee stated they have already corrected the issues and has trained with TSP Carmen Odom. Licensee also trained with their staff 06/06/2025 that all staff were present. LPA also suggested an attestation acknowleding title 22 regulations regarding discipline.
