32 | LPA interviewed 3 staff, including the Director, 2 witnesses, 2 children, and reviewed other evidence in relation to the incident. 3 of 3 staff interviews stated C2 was not seen touching C1 inappropriately nor punching C1 on the playground. Also, 2 of 2 witnesses did not report anything seen related to the allegation. Finally, record review indicated the facility was within ratio at the time of the alleged incidents. Interviews with C1 and C2 produced conflicting accounts, preventing a clear determination of the events surrounding the allegation.
Based on the information obtained from all evidence, the allegation was found to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.
An exit interview was conducted, and a copy of this report was provided along with copies of the confidential names list and Appeal Rights were provided. A Notice of Site visit was given, and the Licensee understands that it must remain posted for 30 days. |
