13 | Licensing Program Analyst (LPA) Tricia Danielson arrived unannounced to the facility to conclude an investigation into the allegation listed above. LPA met with Licensee America Figueroa and explained the purpose of the visit. Regarding the allegation "Staff do not ensure reporting requirements are being followed", there were 2 incidents reported, the first incident involved child #4 had scratches on their leg and face and the second incident involved child #5 who had their arm twisted by another child. Child #5 stated they were crying and that their arm hurt a lot. An interview with Licensee Figueroa confirmed she did not make parental notification about C4 or C5's injuries nor did she submit an incident report to Community Care Licensing (CCL). Although the licensee was not required to submit a report to CCL regarding C4’s injuries, C5 would have required an incident report. Based on interviews conducted and records reviewed, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, are being cited on the attached LIC 9099-D. An exit interview was conducted, and this report was reviewed with and provided to Licensee Figueroa. Appeal Rights were also discussed and provided. An LIC 9213- Notice of Site Visit was also issued and must remain posted near the main entrance for 30 days. Non-compliance with posting will result in a $100 fine. This report must be accessible to the public for three years. *This is an amended report. |
