32 | During the course of the investigation, the Site Supervisor, Melissa Corado, was not interviewed as they are no longer employed at the facility and, despite attempts to interview, contact was not made. On Thursday, 5/7/2026, an incident occurred in which it was alleged that Child 1 was denied water during parent pick-up; Child 1 and their guardian were informed by the Site Supervisor that the facility “ran out of water.” Witnesses of this incident were interviewed in which 3 out of 4 individuals confirmed that there was no water in the water dispenser’s 5-gallon jug and, emergency 8 oz. water bottles were not available. The facility Director stated that she was made aware of the incident on Tuesday, 5/12/2026, so she visited the facility. The Director observed that the water dispenser’s five-gallon jug was almost empty but there was emergency water bottles; the Director photographed a case of 80- 8 fluid ounce water bottles. Additional to this May incident, LPA interviewed a total of 6 children and 2 staff who attended the facility in order to discuss the availability of water in the facility. All children and staff explained that there is a water dispenser with a 5-gallon jug and small paper cups; additionally, they are sometimes given 8 fluid oz. water bottles from the facility's refrigerator. Further Interviews revealed that children can only fill their personal water bottles “halfway” in order to help conserve water. Child 3 stated that there was an occasion where the facility ran out of water and cups, so they had to wait to drink water at home. Child 4 described two separate incidents. Once, Child 4 stated they were so thirsty but was told by the Site Supervisor that they were “almost out of water” and they had to “save the water.” On the other occasion, Child 4 stated that they came inside the facility after playing outside and was told by a staff member that they could not have water as they had to “save water.”
Based on LPA Hurtado’s observations, interviews, and the review of facility records, it was confirmed that the staff violated Title 22 101239.2 Drinking Water (a)(1). They did not ensure that drinking water was available to the daycare children to drink as they wish. The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED.
LPA and the Director reviewed PIN 25-10-CCLD, which discusses preparation for extreme heat and, PIN 25-06-CCLD, which reviews extreme heat prevention. Furthermore, California Code of Regulations Title 22 101239.2 Drinking Water (a)(1) is being cited on the attached LIC 9099D.
A notice of site visit was given to the Director and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Director, Alejandra Piedra. Appeal rights were discussed and provided during the exit interview. |
