On 10/03/2025 at 11:00 am, Licensing Program Analyst (LPA), Griselda Castellon, and Licensing Program Analyst Diana Brasel announced a follow-up pre-licensing inspection to measure the preschool playground. An initial pre-licensing visit was conducted on 09/18/2025, on that date there was not a 4 foot fence in place to separate the preschool playground from the private affidavit program playground. The licensee has installed a fence that exceeds 4 feet tall to separate the two playgrounds. Upon arrival, LPA's met with Tina Naber, licensee, and toured the facility, took a census, inspected and measured the outdoor preschool playground. There were a total of 58 children and 14 staff members, facility met ratios.

The facility currently has a fully fenced playground area. Fencing is made of brick and vinyl fencing which is at least four feet high. The total square footage for the preschool outdoor activity space is 12,844.50 square feet, which is sufficient to accommodate the requested capacity. Shade in the preschool playground is provided via large permanent awning and building overhang, both climbing structures provide shade. There are sufficient outdoor age-appropriate toys and play equipment available on the playground.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

There is a large rock river bed, with a small wooden bridge, and large wooden stepping stones along the fence separating the preschool and private school. It was discussed the need to maintain supervision at all times when children are playing in that area depending on the child's developmental motor skills to ensure safety. Installed fencing was measured by LPAs, all fencing measured at least 4 ft high. There are two climbing structures on the playground which are properly anchored. The first climbing structure is labeled for children ages 2-5 years old. According to provided manufacture specs provided by the licensee the second climbing structure is for children ages 2-12 years of age. There is adequate cushioning in fall zones of climbing structures provided by wood chips.

On 09/18/2025 LPA's measured all indoor and space for the preschool children. The total preschool indoor activity space measured 4,756.73 sq. ft., which is sufficient to accommodate the requested child capacity for the preschool children.

On 09/18/2025 LPA's observed a total of 11 sinks and 8 toilets available for preschool children’s use, which are sufficient to accommodate the requested capacity. A separate staff restroom is available, equipped with a toilet and a sink which is located in the staff lounge. The designated isolation area for children who become ill will be in the main lobby next to the directors desk.



Tina provided a physical copy the private school affidavit application, not a preschool affidavit certificate. LPA encouraged Tina to communicate with the Department of Education to learn about the status of the preschool affidavit application. On this date LPAs observed children in the preschool designated area. Tina will provide a status update on the preschool affidavit application.

On 09/25/2025 a provisional license was issued valid through 03/25/26.

A license for 120 preschool children ages 2-5 years old in classrooms 1,2,3,4,5,6,7,8 and 11. will be granted upon a final file review.

On 09/18/2025 the following corrections were needed:
Indoor:
1. Anchor all cubbies and children's toy shelves in all classrooms.
2. Install fence/gate that is at least 4 ft tall to septate the preschool children and the private school children to avoid commingling.
Preschool Outdoor:
1. Install a 4 ft fence to divide the preschool children from the private school children.
2. Make trees and plants with thorns inaccessible to children.

Director:
1. Submit Orientation Certificate Record Keeping.

NOIA Documents:
1. Submit updated Parent Handbook and Admission Agreement.

On this date LPA's observed the needed indoor corrections have been completed.
In regards to #2 correction for indoors the licensee has installed a retractable gate although it measures from ground to top 4 there is a 2 foot gap at the bottom. LPA's advised the licensee that the gate needed to be lowered to the ground to prevent children from being able to go underneath the retractable gate and it measure 4 feet.
On this date LPA's observed the outdoor corrections to be completed.
The orientation certificate for Record Keeping for the Director has been submitted.
The updated Parent Handbook and Admission Agreement has been submitted.

An exit interview was conducted, and the report was reviewed with the Augustina (Aka Tina) Naber, applicant.
