Licensing Program Analyst (LPA) Natalie Gayoso conducted a complaint visit to deliver findings regarding the above allegations. LPA identified herself and discussed the purpose of the visit and the elements of the above allegation with Resident Services Director Tara Gonzalez.

The Department conducted investigation of allegation to include interviews and records review. Interviews revealed that while staff (S1) attempted to assist resident (R1) with showering, R1 fell to the floor sustaining bruising. Interviews with staff revealed that no staff hit, pushed or caused R1 to fall. Interviews with resident R1 did not reveal that staff caused R1 to fall. LPA could not corroborate that R1 fell as a result of staff handling R1 in a negligent manner. The allegation is UNSUBSTANTIATED. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged abuse occurred.

Licensing Program Analyst (LPA) Natalie Gayoso made a complaint visit to the facility to deliver findings regarding the above allegation. LPA identified herself and discussed the purpose of today's visit and the elements of the above allegation with Resident Services Director Tara Gonzalez.

The Department conducted investigation of allegation to include interviews and records review. Interviews revealed that on or around March 19, 2020 staff (S2) entered into the room of resident (R2) to offer food choices. (S2) became agitated with (R2) and made an inappropriate comment to (R2). Interviews with S2 confirm that an inappropriate comment was made to R2. This poses a potential risk to residents in care. The allegation of facility staff spoke inappropriately to resident is SUBSTANTIATED. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. California Code of Regulations, Title 22 Division 6 & Chapter 8, are being cited on the attached LIC 9099D
