Licensing Program Analyst (LPA) Tricia Danielson arrived unannounced to the facility to conclude an investigation into the allegations listed above. LPA met with Executive Director (ED) Heather Scott and explained the purpose of the visit.
Regarding the allegation "Licensee issued unlawful eviction to resident", it was alleged that Resident #1 (R1) was issued a notice to evict but does not have the capacity to live on their own. Review of eviction letter dated April 24, 2023, revealed R1 was issued a thirty day notice of eviction due to unpaid rent totaling $9,350.00. The letter indicated R1's rent had not been paid since December 2022. The eviction letter indicated R1 would have to vacate the facility May 24, 2023. Interview with R1 revealed R1 was an unreliable historian. During today's visit, the facility received full payment of all funds owed and an eviction for R1 is no longer being sought.
Regarding the allegation "Licensee did not meet the needs of resident", it was alleged that the facility did not contact the Public Guardian's office regarding R1, who does not have the cognitive capacity to control their finances Interview with ED Scott revealed R1 was placed at the facility by APS in October 2022 following R1's discharge from the hospital. The facility was informed by APS that R1 had a Power of Attorney (POA) who was handling R1's matters. After R1's admission, ED Scott learned there actually was no POA for R1 however, R1's insurance covered R1's monthly rent for the months of October, November, and December 2022. Records reviewed revealed ED Scott submitted an application for Social Security benefits on behalf of R1 on October 5, 2022. R1 received notice of appointment from Social Security and an appointment was scheduled for November 25, 2022 however, the Social Security Administration did not keep the appointment. A second application was submitted by ED Scott on December 30, 2022. Also submitted on December 30, 2022, was an application for Public Guardianship. After no response was received regarding Social Security benefits or Public Guardianship, the facility issued a notice of eviction on April 23, 2023. On May 18, 2023 ED Scott received a letter from Riverside County Public Guardian/Conservator which stated they acknowledged receiving the application for Public Guardianship for R1 however the application was being returned due to missing information. On August 18, 2023, R1 was finally placed under conservatorship. Interview with R1 revealed R1 was an unreliable historian. This agency has investigated the complaint alleging "Licensee issued unlawful eviction to resident" and "Licensee did not meet the needs of resident". We have found that the complaint was unfounded, meaning that the allegations were false, could not have happened and/or is without a reasonable basis. An exit interview was conducted and a copy of this report was provided along with LIC811- Confidential Names list.
