32 | On July 7, 2023, Community Care Licensing received information alleging that resource parents did not treat foster child with respect.
During the investigation, it was revealed that a photo of FC was taken while FC was sleeping at the RFH. Confidential interview further reported that this photo was taken by the resource mother without the consent of FC and was later sent to FC’s boyfriend without FC’s knowledge and approval. Confidential interviews supported the information that a photo of FC was taken and stated that the resource mother was reminded by FFA staff about foster children personal rights. A confidential interview also confirmed that the photo of the FC was sent to the FC’s boyfriend by the resource mother. The department also received evidence of the photo taken by the resource mother to further support the information received regarding the complaint allegation that resource parents did not treat FC with respect by taking a photograph of FC and sharing the photo without FC’s consent or approval.
Based on confidential interviews and record review the preponderance of evidence standard has been met, and the allegation that resource mother did not treat FC with respect is supported and proven by evidence, therefore the allegation is substantiated at this time. The FFA is cited for violation of Interim Licensing Standards (ILS) version six SECTION 88487.8(b)(3) PERSONAL RIGHTS (b) In addition to subsection (a), a Resource Family shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment; exploitation; infliction of pain; humiliation; intimidation; ridicule; coercion; threat; physical, sexual, emotional, mental, or other abuse; or other actions of a punitive nature including interference with the daily living functions of eating, sleeping, or toileting, or withholding of shelter, clothing, medication, or aids to physical functioning.
