25 | On October 15, 2024, Licensing Program Analyst (LPA) Stephanie Piring, met with Teacher Rita Gabran for an unannounced case management inspection regarding a self reported incident which occurred on 10/01/2024. Upon arrival LPA observed care and supervision of 24 children on the play ground supervised by 5 staff.
It was reported that on 10/01/2024 approximately around 9:30 AM , children were lining up to exit the classroom. Child #1 was hitting and pushing children in line. Staff #1 asked child #1 to remove from the line. Child #1 refused and continued hitting and pushing children. Staff #1 then picked the child up by placing her hands on the outside of the child shoulders and moving her to a chair near the cubby/restroom area. Child #1 started to cry and staff #1 reportedly told the child she could get in line once she was listening. The incident was initially reported to SETA and SJSUD Administration by a SETA representative. The child's parents were also notified of the incident.
LPA conducted interviews with staff #1 and staff #2 that was present that day. LPA learned that the behavior displayed on 10/1/24 by child #1 is normal behavior. Staff #1 states that the child had to be removed from the line twice, both times by the staff picking the child up under the arms. Staff reported sitting the child in the chair and speaking about appropriate behavior while in line before the child was returned to the line to go outside with the rest of the class. LPA was unable to speak to the SETA representative during todays visit.
Based on todays visit, LPA concluded that no Title 22 regulations were violated. Exit interview conducted and report was reviewed with Facility Representative Cheryl Chen. A notice of site visit was given and must remain posted for 30 days.
