This is an amended report.
Licensing Program Analyst (LPA) Andrea Cortez arrived at the facility and met with Director Hannah Battiste to deliver findings on a complaint investigation regarding the above allegation. Today’s census included 90 children supervised by 15 teachers.

It was alleged that over a period of approximately two months, 2–3 days per week, Child 1 (C1) returned home reporting multiple incidents in which Child 2 (C2) pinched, hit, or spit on C1 while in care.

During the investigation, interviews were conducted with the parents, teachers, and relevant parties. Teachers reported that C1 had not informed them of any incidents involving C2. Teachers stated they had not observed any hitting, pinching, or spitting between the children during the reported timeframe.

Teachers described active supervision practices in the classroom, including teacher positioning and engagement. Records reviewed did not contain documentation of peer-to-peer incidents involving C1 and C2. No witnesses were identified who observed the alleged incidents.

Based on the information gathered, there was not enough evidence to determine that teachers failed to adequately supervise children in care. Although concerns were reported regarding repeated incidents, the investigation did not yield corroborating evidence to support that staff did not provide adequate supervision or that the alleged incidents occurred as described.

The allegation that staff do not adequately supervise day care children is UNSUBSTANTIATED. Although the allegation may have occurred or is valid, there is not a preponderance of evidence to prove the alleged violation.
