On 12/27/22 at 9:50 AM, Licensing Program Analyst (LPA) Chris Hopkins conducted an unannounced facility visit in regards to a complaint investigation with the above allegations. LPA met with Administrator Trisa Cysewski and stated the purpose of this visit.

Regarding the allegation of Staff mismanaged resident’s medication, the Department found the following; based on interview and record review, it was determined that facility staff were waiting for the doctors order to give the prescribed medication. The facility is unable to give medication without the doctors order.

Regarding the allegation of staff threatened to evict resident, the Department found the following; based on interview, it was determined that Administrator and family were discussing all options for R1 because of R1's behavior. Administrator let R1's family know that 1:1 care was not a long term option, because the facility did not provide that. R1's family could not bring him/her home, so the option of eviction did come up, but it was never a threat. Report continued on LIC9099-C...

Regarding the allegation of Resident became severely dehydrated while in care, the Department found the following; based on interview, it was determined that R1 was never dehydrated. Multiple staff stated that R1 always had water and cranberry juice with him.

Based on interviews and record review, it is determined that the preponderance of evidence standard is not met, therefore these allegations are UNSUBSTANTIATED. A finding of unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

On 12/27/22 at 9:50 AM, Licensing Program Analyst (LPA) Chris Hopkins conducted an unannounced facility visit in regards to a complaint investigation with the above allegations. LPA met with Administrator Trisa Cysewski and stated the purpose of this visit.

Regarding the allegation Staff chemically restrained resident, the Department found the following; based on interview and record review, it was determined that R1's MAR indicated R1 needed 3 capsules of 300mg of a medication and .25 mg of a medication that the doctor ordered. R1 was never given 2700mg of any 2 medications, therefore based on the investigation conducted the allegation is UNFOUNDED. A finding that the allegation is unfounded means that the allegation is false, could not have happened, and/or is without a reasonable basis.

An exit interview was conducted, and a copy of this report was provided to facility.

On 12/27/22 at 9:50 AM, Licensing Program Analyst (LPA) Chris Hopkins conducted an unannounced facility visit in regards to a complaint investigation with the above allegations. LPA met with Administrator Trisa Cysewski and stated the purpose of this visit.

Regarding the allegation of Resident was sexually abused while in care, the Department found the following; based on interview and record review, it was determined that R1 did sexually abuse R2 while in care. Staff witnessed R1 touching R2 sexually inappropriate in R2's room.

Due to R2 sustaining serious bodily injury, the violation warrants civil penalty assessments. At this time, the civil penalty assessments are under review, and a civil penalty determination is pending by the Department. Once civil penalty assessments have been determined, an LPA will return at a future date to assess the civil penalties. As a result of this investigation, the Department finds this allegation to be substantiated. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. Deficiency cited on the LIC 9099-D, per Title 22 Regulations and appeals rights given.

Administrator has agreed to do a thorough Pre-Assessment on all new residents and report immediately of any behavorial concerns. All staff have concluded their training on mandating reporting. Administrator will give copies of In-service training by 12/28/22.

Based on interview, record review, and observation, the Licensee did not ensure residents were protected from R1's sexual inappropriate behavior and touching. This poses an immediate health and safety risk to residents in care.
