Licensing Program Analyst (LPA) Kevin Mknelly arrived at the facility unannounced on 4/28/22 to deliver complaint findings. LPA met with Carly and explained the purpose of the visit. Prior to initiating the complaint visit, LPA completed required COVID-19 testing protocols, and a daily self-screening questionnaire for symptoms of COVID-19 infection to affirm no COVID-19 related symptoms. LPA completed a facility risk assessment upon arrival. LPA ensured they applied hand sanitizer before entering the facility and the following Personal Protective Equipment (PPE) was worn: Surgical Mask. Additionally, LPA was screened by facility staff upon entering the facility.

The department reviewed client/resident records and conducted extensive interviews.
The department finds that the allegations cited above are substantiated.

Based on statements and documents, on 3/7/22 three (3) of four (4) residents had 12:00 PM medications delayed until 1:20 PM when staff assumed S1 was to do medication passes yet S1 was not present at the facility at 12:00 PM. Other staff working with clients R1, R2, and R3 did not identify and facilitate that the clients to whom they were assigned received their scheduled medications. Based on medication orders a medication administration record (MAR) identified the resident need for medication at 12:00 PM

Client physicians were contacted, medication times were adjusted and clients suffered no ill effects due to the delay.

As a result of this investigation, LPA finds allegation to be (S) Substantiated - A finding that the complaint is Substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. The following deficiencies were cited on 9099-D, per Title 22 Regulations, Division 6. (A)This poses an immediate Health and Safety risk to clients/residents in care. (B) This poses a potential Health and Safety risk, or personal rights violation, to clients/residents in care.

On 4/28/22, Licensing Program Analyst (LPA) Kevin Mknelly conducted an unannounced complaint investigation visit to deliver the findings for the above allegations and met with clinical staff. Prior to initiating the complaint visit, LPA completed required department COVID-19 screening protocols.Upon arrival, completed a facility risk assessment. LPA conducted records review and extensive interviews.
LPA is unable to find and or meet the preponderance, per policy.

Statements and records found that while it is acknowledged that there were delays for various reasons and for a period of time in cashing cleint P&I checks, no evidenc was found that clients were denied access to requested funds. Reportedly, company funds would be credited to clients if checks confirmed

available client funds. The issues that had caused delays have been resolved for client check cashing.

Additionally, disruptions in facility supplies purchasing were acknowledged in interviews. However, evidence was not found that short supply or delays in supplies impacted clients services or needs.

As a result of this investigation, LPA finds allegation to be (US)Unsubstantiated - A finding that the complaint is Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

Health Related Services(b) Clients shall be assisted as needed with self-administration of prescription and nonprescription medications. This requiremnent was not met based on records and statements that three residents did not did not receive assistance as needed on 3/7/22 with noon medications

The miscommunication issues that resulted in the late medications have been resolved.

Licensee will submit the policy/ proccedures in place for med passes as well as proof staff have been trained on the procedures to CCL by the POC date of 5/18/22.
