Licensing Program Analyst (LPA) Christina Valerio arrived unannounced to conduct a complaint investigation and deliver complaint findings. LPA Valerio met with Administrator Bradford Leggs, and explained the purpose of the visit.

On 05/14/2024, LPA Valerio made an unannounced visit. LPA observed the facility to be clean and free from debris. LPA observed staff interactions with residents to be professional with no negative remarks or tones. LPA Valerio did not observe any smells of marijuana on the premises. LPA Valerio did not observe any bottles of alcohol.

On 05/14/2024, LPA Valerio interviewed 3 residents. According to an interview with Resident 1 (R1), staff are polite, work hard for the residents, are seen to be good role models for the resident, treat them like humans, and want the best for the residents. R1 denied all allegations to be true. According to an interview with Resident 2 (R2), R2 says staff is rude when R2 is told to clean R2's room.

R2 does not like to be told what to do from staff. R2 denied ever seeing staff drink or smoke at the home. R2 stated the residents smoke cigarettes in the backyard. R2 feels safe at the facility and says it is the best facility R2 has ever been.

According to an interview with Resident 3 (R3), R3 likes living at the facility. R3 denied ever seeing staff smoke marijuana or drink alcohol. R3 feels safe at the facility.

LPA Valerio interviewed five (5) staff members. All staff interviews denied that any of the allegations are true.

According to an interview with Staff 1 (S1), staff treat all clients with dignity and respect. Staff remind residents of consequences that could happen in the community if they make bad choices, but it is a reminder. Residents have the right to leave the facility. The residents also have the right to smoke, drink, or do what they want. Staff's job is to make sure they are safe and out of harm from others. Staff do no promote drinking or smoking habits.

According to Staff 2 (S2), S2 never seen or heard of any staff drinking alcohol, smoking marijuana, making derogatory comments to residents, or having behaviors that pose a risk to residents. S2 stated staff have to go by the rules and sometimes residents do not like follow the rules or told what to do. S2 says they treat all staff with dignity and respect.

According to Staff 3 (S3), S3 reported that a resident apologize to S3 for making the allegations. S3 stated the resident said it because the resident wanted more cigarettes. According to S3, the resident smokes and drinking lot of caffeine. S3 would remind residents to clean up the kitchen, the room, and any bodily fluids. S3 stated none of that is true.

According to Staff 4 (S4), S4 never witnessed any of the allegations and S4 worked all different shifts. S4 stated staff were all really nice. S4 stated residents were the individuals to smoke cigarettes in the backyard. S4 stated residents would leave with their friends or family, get a little tipsy, and come back home.

LPA Valerio reviewed residents records for Resident 1 - Resident 3. According to resident records, residents are able to leave the facility unassisted and need little assistance with activities of daily living.

LPA Valerio observed the facility on 04/08/2024, 05/14/2024, and 06/04/2024. LPA did not observe staff making derogatory remarks to residents. LPA observed staff assisting residents, if needed, prompting residents for daily activities, and engaging with residents in a professional manner. LPA observed staff behaviors to be professional.

Based on all the information collected by the Department there is not a preponderance of evidence to prove the allegations occurred, therefore the allegations are UNSUBSTANTIATED.

Per California Code of Regulations (CCR) - Title 22, Division 6, Chapter 1, no deficiencies are being cited.

An exit interview was held, and a copy of report was left at the facility.
