Licensing Program Analyst (LPA) Christina Valerio arrived at the facility unannounced to deliver complaint investigation findings. LPA Valerio met with facility staff and explained the purpose of the visit. LPA was later met by Administrator Monalyn.

The Department has determined the following as it relates to the following allegation: Staff do not provide adequate supervision resulting in residents wandering away from facility. The investigation consisted of interviews with staff, interview with the reporting party, interview with neighboring residents, and records review.

Based on reports from the Reporting Party (RP), the RP states the residents and has have caused safety problems in the neighborhood by repeatedly walking down the road in front of the property, loitered loitering in front of the house, trespassing on their property, climbing on our fences, harassing livestock and family pets, and going through their mailbox.

RP stated, "That type of violent individual does NOT belong in a residential neighborhood, with frail seniors and with little children who wait for the school bus out on Cherokee, especially when the staff cannot keep the residents confined to the facility, need to protect themselves from the individuals with riot shields and lack the training to deal effectively with their violence."

The RP stated that on 12/20/2023 around 10:00 AM, Resident 1 (R1) ran out of the facility without staff. RP was driving and almost hit the resident. RP had to slam on the breaks to prevent from hitting the resident. RP said the resident banged on the car several times and made death threats towards RP.

RP stated they were so scared that they reversed the car and R1 chased the car and continued to hit the car and threaten RP. RP said four staff came running out with riot shields. RP stated they are is scared for RP's life and can't go outside now and is trapped in their own home. RP said the licensee did not let the neighborhood know about the type of facility.

According to a review of the Facility Program Design, Hopeful Tomorrow Home is a staff operated Enhanced Behavior Support Home (EBSH) that provides 24-hour non-medical resident care services. Hopeful Tomorrow Homes supports clients with person centered planning in the form of supporting clients with mental and behavioral health. There are instances where staff needs to utilize de-escalation techniques or utilize tools to ensure residents are kept safe from self injurious behaviors. For example, Ukeru Pads are utilized in the home to prevent residents from hitting themselves, others, or to lessen the amount of harm. According to ukerusystems.com, Ukeru Pads are implemented as a restraint free approach and is a simple, yet highly effective approach to crisis management that offers an alternative to coercive behavior techniques.

LPA Valerio interviewed staff that were present during the incident. According to Staff 1 (S1), S1 arrived at the facility on 12/20/2023 and saw R1 in front of the home. R1 yelled "look at me hurt the car". S1 observed the house staff follow R1 outside and utilize the "blue pads" [Ukeru Pads] to block R1. R1 continued to attempt to hit the staff while the therapist attempted to calm R1 by using de-escalation techniques . R1 then ran into the street and blocked a car from proceeding. Staff and therapist was able to redirect R1 back to R1's room.

While speaking with R1, R1 did not appear to calm. R1 then began to throw chairs and other house items at staff. R1 then ran outside again where R1 blocked a car and truck. Staff were able to redirect R1 back into the home with the use of the blue pads. R1 then spoke with the police on the phone. While speaking on the phone R1 appeared visibly calmed. After some time, the police counselor arrived at the house and spoke with R1. After which R1 decided to go for a walk to calm down. According to the interview with S1, S1 stated that S1 did not witness, at any time during the incident, see R1 hit another person's car or yell at the neighbors. S1 stated the staff had already had the pads out due to R1's behaviors. R1 ran out and blocked two cars. Then a neighbor gets out of the car and was cussing at the R1. The staff were trying to apologize and tell them to be patient as they guide R1 out of the road. Staff directed the R1 to the side of the road and told them to pass. The neighbor pulled up to the house while staff were outside.

Staff 1 (S1) was asked to demonstrate how the staff surrounded the resident as soon as he ran in the street. Based on LPAs observation, the resident would be in the center and the four individuals wrapped around like a donut

LPA interviewed Staff 2 (S2). S2 was present during the 12/20/2023 incident. S2 did not believe R1 hit any oncoming traffic car. The only car that was hit was staff. LPA stated that it is alleged that residents have been trespassing the yard, going into mailboxes, and hoping over fences. S2 stated that is simply not true. Staff are always with him. S2 stated R1 is currently on a staff to resident ratio of 1:1. When R1 is out in the community, the resident has a 2:1 ratio. S2 stated R1 was having behaviors for two hours, during that day. R1 was already in the front of the house, behind the gate, and staff were already carrying the pads. While R1 was having behaviors, staff saw R1 run out the gate and staff immediately followed R1. That is when R1 went in front of the car. Staff already had the pads and immediately surrounded R1. S2 never saw R1 hitting any cars when that happened. R1 was saying profanity and yelling out loud. S2 did not see anyone recording the incident. Staff waved to the people in the car to go but they did not go. One of them waited until the police officers came. Then when the police officers came, they talked to the officers. The officer provided counseling and then they left.

LPA interviewed Staff 3 (S3). S3 was present during the incident and did not observe R1 hitting neighboring cars and did not leave without staff supervision.

LPA Valerio reviewed Unusual Incident Report, Shared Information Report, and Behaviorist Incident Report. The information regarding the incident aligned with the statements provided by the staff and did not indicate R1 was without staff supervision.

LPA Valerio reviewed the Regional Office electronic files for Unusual Incident Reports (UIR). The Regional Office has not received any UIRs regarding R1 leaving the facility without staff supervision.

LPA Valerio reviewed Facility Records for R1. R1 is required a high level of care and supervision. R1 receives 1:1 Direct Care staff, 20/hour per month of staff Behaviorist, Consultant (non-behaviorist), outside activities that consists of an LMFT, Recreational Therapist, Dietician, Registered Nurse, Music Therapy Group, Music Therapy 1:1, personal chef and access to a privately funded physician. R1 has 1-3 staff present at all time when going out into the community.

LPA Valerio interviewed a neighbor that witnessed the incident on 12/20/2023, Witness 2 (W2). According to the interview, W2 stated R1 was beating on hoods. W2 saw R1 pounding on that Witness one (W1)'s car telling W1 that R1 was going to kill W1. Then R1 rushed to my car telling me R1 was going to kill me. Then you got the staff yelling at me telling me to get back in the car. Telling me to get back in my car for safety. This is our neighborhood, and this place was illegally placed in our neighborhood. When R1 was beating on the car of the neighbor, I went up to the home. No one was even in the home. I looked inside. There were tables flipped. W2 stated a video recording was taken on W2's phone. However, W2 could not locate the video on their phone to provide LPA Valerio for evidence and mentioned that  the video could have been deleted. W2 stated R1 has been seen walking down W2's private driveway with staff. W2 states even though it is private property, the staff and R1 still walk there because they cannot walk on the main road. W2 stated the neighborhood is not safe for children because of the facility. W2 stated the neighborhood has a neighborhood watch program to ensure they are kept safe from the residents. W2 states no one informed the neighborhood of the facility when it first opened.

Based on all the information collected by the Department there is not a preponderance of evidence to prove the allegation occurred, therefore this allegation is UNSUBSTANTIATED. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, and therefore the allegations are unsubstantiated.

Per California Code of Regulations (CCRs) - Title 22, Division 6, no deficiencies are being cited. An exit interview was held, and a copy of report was provided to Administrator Monalyn.
