On 04/07/2025, Licensing Program Analyst Katy Velazquez (LPA) conducted an unannounced complaint investigation. LPA arrived at the Center and observed 41 preschool aged children being supervised by 5 staff members. LPA accessed Guardian to determine that all required adults were background cleared and associated to the license. LPA met with Director Amy Moreno (D1).
Throughout the course of the investigation, LPA conducted physical plant inspections, on-site observations, interviews, reviewed and collected documentation. It was alleged that staff members do not appropriately supervise day care children. On 04/03/2025, documentation confirms that 1 child shoved another child to the ground and repeatedly hit the child. Interviews revealed that the staff members who were supervising the playground during the time of the incident did not see nor stop the incident. The 2 children did not have visual observation while fighting on the playrgound.
Based on interviews, file reviews, and observations conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A Type-A deficiency was cited on a subsequent 9099-D page. CONTINUED ON 9099-C

On 04/07/2025, Licensing Program Analyst Katy Velazquez (LPA) conducted an unannounced complaint investigation. LPA met with Director Amy Moreno (D1). Throughout the course of the investigation, LPA conducted physical plant inspections, on-site observations, interviews, reviewed and collected documentation. It was alleged that the center is operating out of ratio. It was reported that a staff member walked out of a classroom on 04/03/2025, leaving the co-teacher over ratio with more than twelve 2 year olds. Attendance records confirm that 2 staff members were required in the Discovery Preschool classroom on this date; however, interviews did not reveal corraboration for this incident.
Based on interviews and documentation gathered, there was not a preponderance of evidence to prove or negate the allegation, therefore the allegation is UNSUBSTANTIATED. In the areas that were evaluated on 04/07/2025, no deficiencies were cited during today's inspection. An exit interview was conducted with Director Moreno and Appeal Rights were provided by LPA. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

D1 acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 9099-D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee.
An exit interview was conducted, and the report was reviewed with Director Moreno. LPA provided Licensee Appeal Rights to D1. Director Moreno will select days per week that she will stay at the facility until closing to observe afternoon playground supervision. Director Moreno provided LPA with a statement of her supervision plan. LPA cleared the citation while on site and provided D1 with a letter of clearance.

This regulation was not met as evidenced by 2 children fighting on the playground on 04/03/2025 when 4 staff members did not see nor stop the altercation. This lack of supervision poses/posed an immediate health, safety or personal rights risk to persons in care.
