32 | Staff are comingling kindergarten component children with school age children.
It was alleged that, during the spring break period of 03/30/2026 through 04/03/2026, staff placed children enrolled in the kindergarten program in the school-age classroom for the full operating day throughout the spring break period.
Based on interview, the Director stated the kindergarten and school-age classrooms were combined during spring break for the entire week. Staff interviews confirmed children enrolled in the kindergarten program were placed in the school-age classroom for the full operating day throughout the spring break period.
Based on record review, the school-age classroom attendance logs document the presence of children identified on the Kindergarten Roll Call Sheet as in the school-age classroom during the spring break period of 03/30/2026 through 04/03/2026.
Based on the evidence available, the preponderance of evidence standard has been met, therefore the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, ยง101161(a), is being cited on the attached LIC 9099D.
One Type A Deficiency is cited on the subsequent page of this report (LIC809-D) under the California Code of Regulations, Title 22. The licensee was provided a copy of their Appeal Rights (LIC9058) and the licensee's signature on this form acknowledges receipt of these rights.
LPA Hatch informed the licensee to provide a copy of this licensing report dated 05/28/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
