13 | On 12/08/2023, Licensing Program Analyst Katy Velazquez (LPA) conducted an unannounced complaint investigation to deliver the findings for the above allegation. LPA met with Director Donyale Roberts (D1). Throughout the course of the investigation, LPA conducted physical plant inspections, on-site observations, and interviews. LPA reviewed and collected documentation pertaining to the allegation. It was alleged that staff not attending to daycare child caused the daycare child to eat chalk. Interviews reveal that although the child placed the non-toxic chalk in their mouth, it was not due to a lack of supervision. A teacher was present and immediately removed the chalk from the child’s mouth.
Based on interviews, observations, documentation, and other information gathered, there was not a preponderance of evidence to prove or negate the allegation, therefore the allegation is UNSUBSTANTIATED. In the areas that were evaluated on 12/08/2023, no deficiencies were cited during today's inspection. An exit interview was conducted with D1, and Licensee Appeal Rights were provided by LPA. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
