On 12/08/2023, Licensing Program Analyst Katy Velazquez (LPA) conducted an unannounced complaint investigation to deliver the findings for the above allegation. LPA met with Director Donyale Roberts (D1). Throughout the course of the investigation, LPA conducted physical plant inspections, on-site observations, and interviews. LPA reviewed and collected documentation pertaining to the allegation. It was alleged that a lack of supervision resulted in daycare children wandering away from the facility. Interviews and evidence revealed that on 11/13/2023, 3 children exited the facility through an unlocked gate on the playground. The 3 children were unsupervised in a parking lot for 2 minutes before being returned to the facility by an unknown adult.
Based on interviews, file reviews, and observations conducted the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

Deficiencies were cited on a subsequent 9099-D page and Civil Penalties were assessed. D1 acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 9099-D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's files as a receipt whenever any Type A documents are provided by the Licensee.
An exit interview was conducted, and the report was reviewed with D1. LPA provided Licensee Appeal Rights to D1. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

A chainlink fence was installed on 12/02/2023 which creates a barricade to the area of the playground with the exit gate. However, the grass area on the side of the building creates a line of sight issue for supervision. D1 will create a new playground schedule which requires more than 1 classroom to use the

Supervision shall include visual observation.
This requirement was not met as evidenced by 3 children exiting the facilty unsupervised on 11/13/2023.

playground at one time. This will ensure that more than 1 teacher is on the playground for supervision of all areas, including the grass. All staff members will read and sign the new playground policy and schedule. The policy and schedule will be emailed to LPA by 5 pm on 12/11/2023.

On 12/08/2023, Licensing Program Analyst Katy Velazquez (LPA) conducted an unannounced complaint investigation to deliver the findings for the above allegation. LPA met with Director Donyale Roberts (D1). Throughout the course of the investigation, LPA conducted physical plant inspections, on-site observations, and interviews. LPA reviewed and collected documentation pertaining to the allegation. It was alleged that staff not attending to daycare child caused the daycare child to eat chalk. Interviews reveal that although the child placed the non-toxic chalk in their mouth, it was not due to a lack of supervision. A teacher was present and immediately removed the chalk from the child’s mouth.
Based on interviews, observations, documentation, and other information gathered, there was not a preponderance of evidence to prove or negate the allegation, therefore the allegation is UNSUBSTANTIATED. In the areas that were evaluated on 12/08/2023, no deficiencies were cited during today's inspection. An exit interview was conducted with D1, and Licensee Appeal Rights were provided by LPA. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
