On 12/08/2022 at approximately 9:00am, Licensing Program Analyst (LPA) Arianna Manabat met with Assitant Directors Franklin Bay and Art Astia to deliver complaint findings for the allegations mentioned above. LPA observed 45 children in care being supervised by 7 staff.

It was alleged that facility staff are forcing daycare children to nap and that facility staff caused injuries to a daycare child. Through observations, and interviews with the Director, staff members, children, and the Reporting Party (RP), LPA found that staff members are redirecting children during nap time to a quiet activity. During children interviews it was stated that, during a nap time incident, facility staff was preventing another day care child from stepping on cots or injuring other children with toys. It was stated in interviews that the facility staff was alone in the room and attempting to redirect a child during this incident.

Record reviews indicated that the child had record of scratches on their arm but, based on interviews and record review, it could not be determined that the child sustained injury directly from a facility staff member or at the facility. Based on the information obtained, LPA was not able to determine that the above allegations have occurred at the facility. Therefore, the allegation is determined to be UNSUBSTANTIATED, meaning that although the allegations may have happened or is valid, there is not a preponderance of evidence to prove it. An exit interview was conducted. Notice of site visit and appeal rights were also addressed. The Notice of site visit shall remain posted for 30 days for guardian/parental review.
