On Thursday April 11th, 2024 Licensing Program Analysts (LPAs) Mandie Goodwin and Amanda Sutter met with Director Crystal Johnson to continue a complaint investigation and deliver findings. Upon arrival LPAs observed 37 preschool children between 6 classrooms.

It was alleged that staff are speaking inappropriately towards daycare children and that staff are not providing adequate supervision to the daycare children. During the course of the investigation, LPAs conducted interviews, collected documentation and made observations. During observations on 2/01/24 after touring classrooms LPAs Goodwin and Vang were observing the postings in the hallway when they heard a teacher from the “shape zone” class, 3 doors down the hall, loudly state "No, thank you! No, thank you! No, thank you!" A child started crying. LPAs also heard from the bathroom with the door shut a staff member yelling "hands to yourself, I don't like that!" Continued on 9099-C

At 10:52am LPAs were in an empty room conducting interviews when they heard a staff member shouting "hey" multiple times from down the hallway. LPA Vang stepped out of the classroom and made observations from 10:52am-11:21am. During this time LPA documented that the loud "hey" was coming from classroom "imaginary". While in the hallway LPA could additionally hear a loud voice from Club K instructing children to "stop it" and to share the toys. At 11:00am LPA heard from her position in the hallway a staff member in the Monkey Biz room saying "Hey, stop it!” in a loud voice. LPA walked over to the door and could observe the teacher bending over a child sitting at the table and talking to them. At 11:10 LPA heard a staff member yelling a student’s name from the Shape Room. At 11:21am LPA heard an escalating voice yelling, "No thank you! Stop! No thank you! No!" from the Shape Zone Classroom. LPA walked over to the classroom and observed a staff member cleaning up the classroom toys. LPA entered the classroom and the staff member lowered their voice. Director entered the room after LPA and instructed class to go outside.

One child in interviews stated a teacher (S1) used to be really mean and would hold their hands really hard. The child also stated that S1 would grab the student’s legs and pull them into circle really hard. The child additionally stated that they are put in time out and the teachers uses a loud voice that makes them feel scared. A separate child interviewed stated that S1 grabs children’s hands to put them in time out and that they grab hard and it makes them sad. The child additionally stated that another staff member (S2) grabs children’s arms hard to go on time out. When asked how teachers talk at the school the child stated that S1, S2, and another staff member (S3) scream and it sounds hard and loud and kids feel sad.

One parent interviewed stated that they observe some teachers yelling and don’t think it’s ok. They stated “I definitely hear them yelling “You’re not listening" "you’re not paying attention”. Another parent stated about a specific staff member that “she’s just not nice. And not patient at all. I’ve seen her snatch a toy and grab it out of this little girl’s hands.” The parent did not know the staff members name.

On 4/11/24 LPAs Goodwin and Sutter arrived at 1:45pm to close complaint. LPAs toured the facility to get a census. At 1:45 PM, LPA Sutter observed a staff member leave classroom “Shape Zone”. LPA observed door to be open and LPA Goodwin walk into the classroom. LPA Goodwin observed one child in Shape Zone with no teacher present. LPA Sutter walked into classroom Monkey Business and observed 5 children in the classroom and no staff. A minute later, a staff member (S2) walked into the classroom and stayed. LPA Goodwin stayed in Shape Zone. LPA Sutter went to classroom Club K and observed 1 staff supervising 10 children. Continued on 9099-C

LPA Sutter then went to the Café, across from Shape Zone, and observed 2 children sleeping and no staff member in the classroom. There were no staff present in the hallway. Child woke up crying, picked up their mat, and said, “All done.” LPA Sutter then walked the child over to classroom Imaginary while LPA Goodwin stayed and observed the children still asleep in Café and Shape Zone. Director came over at 1:50 and Director moved the children to other classrooms. LPA Sutter observed one staff supervising 8 children in classroom “imaginary”. LPA Sutter then went to classroom Kinder College. At 1:51 PM, LPA observed the classroom door to be propped open. Eleven children were sleeping in the classroom and no staff member was present. LPA knocked on the break room door, which was closed and is adjacent to the Kinder College classroom, and spoke with two staff members (S4, S5) who stated that they were on break. Director then walked down the hallway toward the Kinder College classroom toward the break room and spoke with staff. LPA observed staff member S5 walk into the Kinder College classroom to supervise children.

At 2:27pm LPA Goodwin was in Café and observed S1 leave the Club K classroom to go find a staff member to step in for them. LPA did not observe anyone step in to Club K prior to S1 leaving, leaving the 11 children unattended in the classroom. At 2:51 PM, LPA Sutter walked from the Café toward Kinder College and observed a staff member (S5) walk with a child into Imaginary. LPA observed no other staff in the classroom, meaning that the classroom had been empty prior to 2:51 PM. LPA did not observe a staff member leaving Imaginary prior to 2:51 PM.

LPA interviewed staff members. A staff member stated that they did leave the classroom with no staff member in it, but it was ok because the children were sleeping and that they are told it’s ok to leave the room as long as children are sleeping. They stated all the staff do that. Another staff member stated that during nap they start out in the classroom and get all the students down. Once the students are asleep the doors are closed and staff walk down the halls to watch the children. LPAs did not observe staff walking the hallways during investigation. LPAs additionally observed that the classrooms are dark and that you can not see children’s faces by looking into the windows. Staff member stated that they open the door if they can’t see into the classroom. LPAs observed a staff schedule which shows at the time that LPAs arrived at the facility on 4/11/2024, there are 4 staff members scheduled to be supervising children and 6 classrooms were open and being used for nap.

Based on observations, interviews, and documentation review the preponderance of evidence standard has been met; therefore, the above allegations are substantiated. Cont. on 9099-C

LPA Goodwin informed Director that this report dated 4/11/24 documents two Type A citations which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. This is a repeat violation for absence of supervision and facility was assessed a civil penalty in the amount of $1000.

Also, LPA Mandie Goodwin informed the Director to provide a copy of this licensing report dated 4/11/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview with Director Crystal Johnson was conducted and appeal rights were provided.
