On Wednesday, October 9, 2024, Licensing Program Analyst (LPA) Amanda Sutter and Licensing Program Manager (LPM) Seychelle De Luca met with Director Crystal Johnson to deliver findings regarding the above allegation. Upon arrival, LPA observed 17 children supervised by 4 staff.

It was alleged that staff put a pull up on Child 1 (C1) that belonged to another child, causing marks on C1. LPA interviewed staff and learned that there was in incident in which a staff member had grabbed the wrong pull up off the shelf in bathroom where diaper changes happen. LPA learned that the pull ups were labeled and that the pull up used on C1 did not belong to C1. The pull up that was used on C1 was too small for the child, resulting in marks on the child.

On Wednesday, October 9, 2024, Licensing Program Analyst (LPA) Amanda Sutter and Licensing Program Manager (LPM) Seychelle De Luca met Director Crystal Johnson to deliver findings regarding the above allegations. Upon arrival, LPA observed 17 children supervised by 4 staff. It was alleged that staff was disrespectful to a parent in front of a child and that staff did not tell parent about incidents that occurred.

During the course of the investigation, LPA interviewed staff and parents regarding communication with parents. LPA learned that the center provides incident reports to parents at the time of pick-up and calls parents regarding sickness and illness if necessary. Staff also communicate with parents directly at pick-up. Based on interviews, LPA could not determine if staff did not tell parent about incidents that occurred or if staff was disrespectful to a parent in front of a child, therefore the above allegations are determined to be UNSUBSTANTIATED, meaning that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove it. An exit interview was conducted. Appeal rights were provided. A notice of site visit was provided and shall remain posted for 30 days.

On 10/9/2024, LPA and LPM observed that Staff 2 (S2) wrap her arms around children by the torso and put them on time out. Through previous interviews, LPA learned that S2 will block children with her body to keep children on time out and will grab them by the wrist to keep them on time out. At 9:50 AM, LPM observed S2 on the playground with children. Child 2 (C2) was not wearing shoes and was sitting on a plastic bench with legs facing outward while S2 was positioning her body to hold the child on the bench. S2 went to get C2’s shoes, then sat down on the bench and moved C2’s leg so that one foot was on the bench and one was hanging off. LPM and LPA observed S2 grab the child’s foot and forcefully put it down on the bench multiple times. LPM and LPA observed staff firmly say, “Stop” while positioning her face within an inch or two of the child’s face, and later, “No” while holding her finger within a few inches of the child’s face.

Based on the observations and interviews, the preponderance of evidence standard has been met; therefore, the above allegations are SUBSTANTIATED.

One Title 22 Deficiency has been issued on the attached LIC 809-D. The licensee was informed that this report dated 10/9/2024 documents one Type A citation which shall be posted for 30 consecutive days. The licensee shall also provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Licensee has been provided with appeal rights. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Crystal Johnson.
