On Wednesday, October 9, 2024, Licensing Program Analyst (LPA) Amanda Sutter and Licensing Program Manager (LPM) Seychelle De Luca met with Director Crystal Johnson to deliver findings regarding the above allegations. Upon arrival, LPA observed 17 children supervised by 4 staff.

It was alleged that staff 1 (S1) handled day care child in a rough manner. LPA conducted interviews with staff, children, and the director, and while LPA could not determine if S1 had handled a day care child in a rough manner, throughout the course of the investigation LPA learned of other incidents in which facility staff had handled children in a rough manner.

On 10/9/2024, LPA and LPM observed that Staff 2 (S2) wrap her arms around children by the torso and put them on time out. Through previous interviews, LPA learned that S2 will block children with her body to keep children on time out and will grab them by the wrist to keep them on time out. At 9:50 AM, LPM observed S2 on the playground with children. Child 2 (C2) was not wearing shoes and was sitting on a plastic bench with legs facing outward while S2 was positioning her body to hold the child on the bench. S2 went to get C2’s shoes, then sat down on the bench and moved C2’s leg so that one foot was on the bench and one was handing off. LPM and LPA observed S2 grab the child’s foot and forcefully put it down on the bench multiple times. LPM and LPA observed staff firmly say, “Stop” while positioning her face within an inch or two of the child’s face, and later, “No” while holding her finger within a few inches of the child’s face.

It was also alleged that staff used an inappropriate form of punishment. LPA conducted interviews with Director, parents, and children. LPA learned that Staff 3 (S3) left the facility following an incident of inappropriate punishment. LPA learned that S3 had hit a Child 1 (C1) on the bottom with a ruler in a classroom. Four out of six children interviewed stated that the incident occurred.

Based on the observations and interviews, the preponderance of evidence standard has been met; therefore, the above allegations are SUBSTANTIATED.

One Title 22 Deficiency has been issued on the attached LIC 9099-D. The director was informed that this report dated 10/9/2024 documents one Type A citation which shall be posted for 30 consecutive days. The director shall also provide a copy of this licensing report to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Director has been provided with appeal rights. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Crystal Johnson.

Staff 3 no longer works at the facility. Director will conduct a training with staff regarding discipline policy and staff communication. Director also stated she will contact Child Action regarding staff training as well.
