On Wednesday, May 14, 2024, at approximately 2:30 PM Licensing Program Analyst (LPA) Josiah Gathing met with Director Danelle Ingalls, for the purpose of a complaint investigation and to deliver findings. It was alleged that staff do not provide adequate food service, staff do not conduct required fire drills, and staff restrained a child in a chair. Throughout the course of the investigation, LPA conducted interviews, reviewed documents, and made observations.
Staff stated in interview that meals provided to the children often do not match the menu. Director stated that the menu is subject to change. LPA advised Director that the menu should be followed as often as possible and any changes should be documented.
Staff interviews disagreed whether fire drills were conducted within six months. Director was unable to produce a fire drill log upon request.
According to staff and child interviews, a child wearing a large shirt (provided by the facility) over his own shirt was restrained in a chair when staff hooked the large shirt over the back of the chair.

On Wednesday, May 14, 2024, at approximately 2:30 PM Licensing Program Analyst (LPA) Josiah Gathing met with Director Danelle Ingalls, for the purpose of a complaint investigation and to deliver findings. It was alleged that licensee is operating in violation of the facility fire clearance and staff do not provide adequate supervision to children in care. Throughout the course of the investigation, LPA conducted interviews, reviewed documents, and made observations.
Staff stated in interview that the fire inspector instructed Director to remove curtains not treated for fire resistance. Fire inspector stated in interview that materials like curtains must be removed or treated for fire resistance. LPA determined in interview with fire inspector that the fire clearance for the facility was not revoked. Therefore, the facility is not operating in violation of fire clearance.
Staff interview assessments of supervision differed. Parent interview assessments of supervision also differed. Children stated in interview that teachers always stay with the children. LPA observed full supervision of children in care throughout the investigation.
Although the alleged violations may have happened or are valid, the preponderance of evidence standard has not been met to fully prove or disprove that they did or did not occur, therefore, they are unsubstantiated. An exit interview was conducted and a notice of site visit provided. Notice of site visit shall remain posted for 30 days.

Therefore, based on record review, the preponderance of evidence standard has been met, and the allegation is substantiated.
Title 22 deficiencies are cited on the subsequent pages of this report. Director acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 9099D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided. Director's signature on this report acknowledges receipt of these rights. This report was reviewed with the Director. An exit interview was conducted. A Notice of Site Visit was provided and shall remain posted for a period of 30 days.
Upon receipt, Director shall post and provide copies of this licensing report to parents/ guardians of children who are currently enrolled as well as parents/ guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must acknowledge receipt of this report and citation by signing a LIC9224, “ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS”. A copy of this form should be placed in each child file upon receipt from parent.
An exit interview was conducted and a notice of site visit provided. Notice of site visit shall remain posted for 30 days. Appeal rights were provided to the Director.
