On September 1, 2022, at 8:30 AM, Licensing Program Analyst (LPA) Alize Tillery arrived to the facility to open a complaint investigation regarding the above allegations. Upon arrival, LPA observed 16 children, supervised by Staff #1 and Staff #2, in the outdoor play area. Moments after LPA arrival, Assistant Director arrived to assit LPA throughout the visit. LPA observed both Staff #1 and Staff #2 personnel files, record review revealed that Staff #1 is a fully qualified teacher and Staff #2 is an Aide (with zero units). Per Title 22 regulation, facility may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. This requirement was not met and poses an immediate risk to children, as Staff #1 and Staff #2 had a total of 16 children. The allegation, "Facility classrooms are operating out of ratio", is Substantiated.

At 9:03am, LPA observed Staff #3 supervising 6 children in the "Friends Classroom" and at 9:54am 10 children in the "Friends Classroom". LPA observed Staff #3's personnel file, which revealed that Staff #3 only has 3 units in Child, Growth and Development. Interview with Assistant Director also revealed that Staff #3 has been acting as a qualified teacher and supervising children alone. Staff #3 is an Aide and should be accompanied by a Qualified Teacher. This poses and immediate risk to children, and allegation "Unqualified staff are providing supervision to children in care", is Substantiated. Based on information obtained during observations, interview and record review, the preponderance of evidence standard has been met, therefore both allegations are found to be SUBSTANTIATED.

Exit interview conducted and report was reviewed with the Assistant Director, Vanessa Halliwell.

A Title 22 deficiencies are cited on 9099D page. Assistant Director acknowledges, that for TYPE A DEFICIENCIES ONLY upon receipt, Assistant Director shall post the 9099D page with Type A deficiency for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the Assistant Director. LIC9224 and Appeal Rights were provided. An exit interview was conducted and a Notice of Site Visit posted.
