On Tuesday, 17 December, 2024, at approximately 10:30 am, Licensing Program Analyst (LPA) Fabian Schwartz met with Licensee, Aretha Abarca, for the purpose of an unannounced annual inspection. Upon arrival, LPA observed licensee and spouse supervising children 9 children, 3 of which are infants. All individuals subject to criminal background review have obtained a criminal record clearance. LPA observed proper ratio and capacity was being followed. Facility hours of operation are 24/7. LPA verified that the annual fees are current.

A health and safety evaluation was conducted in all areas accessible to children. Facility is a 4 bedroom, 3 bathroom two-story home Off-limit areas include: Garage, Upstairs, and Washroom. Licensee acknowledged that children may never enter these off-limit areas. Stairs of home have two access points, one in front hallway and the other into the living room. During inspection, the stairs to living room was not barricaded per regulations although there were children under 5 in care. LPA observed that the facility is clean, sanitary, and in good repair. LPA observed a functioning smoke detector, carbon monoxide detector, and a 2A10BC fire extinguisher which was observed to be still in the box and not full which is against licensing regulations. The facility has adequate toys that appear to be safe for children to use. The licensee stated there are no weapons in the home. LPA observed can of poison bug spray in unlocked, unlatched cabinet under kitchen sink. LPA also observed chemicals in unlatched cabinet under kitchen sink and under sink in bathroom which were accessible to children in care. LPA observed that there is a fenced backyard with a hot tub which has a cover meeting regulations.

LPA reviewed 4 children’s files. Required postings were seen on board immediately to right of front door. Facility did not have children’s roster. LPA did not observe infant sleep plan (LIC 9227) or 15-minute observation checks for napping infants. The facility does not have record of conducting fire drills at least every 6 months and no fire drill log was observed at facility. Licensee’s CPR/First Aid card expires on 19 January 2026. Licensee and assistant did not have Mandated Reporter certificates during time of inspection. Licensee understands that trainings must be completed every two years.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

A notice of site visit was given and must remain posted for 30 days. Based on the inspection, 3 Type A and 5 Type B Title 22 deficiency citations have been issued. Type A citations are for facility having poisons at facility which were not stored behind a lock, having chemicals accessible to two places in facility, and not having a full size 2A-10-BC fire extinguisher at facility. Type B Citations are for not having stairs barricaded at facility, not having a current mandated reporter certificate, not having a current roster at facility, facility not maintaining sleep logs for infants in care, and not maintaining a fire drill log with documented fire drills at least every 6 months.

Title 22 deficiencies are cited on the subsequent pages of this report. Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the Licensee. LIC 9224 and Appeal Rights were provided. Licensee's signature on this report acknowledges receipt of these rights.

Exit interview conducted and report was reviewed with the licensee. During the exit interview, the Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Appeal Rights were provided.
