Licensing Program Analyst (LPA) Salene Mayberry met with Director, Frisha Moore to deliver findings for the above complaint allegation. During the investigation LPA toured the facility, observed staff interactions with children in care, conducted interviews and obtained pertinent documents.

Licensing received two separate complaints for this facility on September 14, 2022, one under the preschool license (#343612912) and one under the infant license (#343621911). Statements made by both Reporting Parties alleged that the “facility is not following proper sign in/out procedures for day care children in care”. Interviews conducted by LPA consistently referenced an on-going issue with parents not signing their children in/out of care. Interviews also revealed that staff were then signing the children in/out of care when parents failed to.

Based on a preponderance of evidence obtained the complaint regarding the above allegation was SUBSTANTIATED.

A Type B Deficiency was cited on the subsequent page (LIC9099-D) of this report.

An Exit interview was conducted in which the report was reviewed and discussed with the Director. LPA provided a copy of the report and Appeal Rights to Director. A Notice of Site visit was posted by LPA and Director understands it must remain posted for 30 days.

Director will create and provide a new policy to parents informing them that they need to personally sign their children in/out of the center and that failing to do so will require them to return and possibly incur a fee. Staff will receive disciplinary action for signing children in/out.

Licensing Program Analyst (LPA) Salene Mayberry met with Director, Frisha Moore to deliver findings for the above complaint allegations. During the investigation LPA toured the facility, observed staff interactions with children in care, conducted interviews and obtained pertinent documents.

It was alleged that the “Facility is operating out of ratio”. LPA toured the facility and the classrooms and did not witness any ratio issues. Additionally, staff interviews were consistent in expressing not ever having been out of ratio.

It was next alleged that the “Staff are not following proper food service sanitation practices”. Interviews with staff did not reveal a concern regarding how food is being handled at the facility. In addition, LPA’s observations of the kitchen and dishes being used for meals appeared to be clean.

It was also alleged that “Napping equipment for day care children is not arranged so that children have access to a walkway without having to walk on/over the cots or mats of other children”. Interviews with staff and LPA’s observations of the spacing of cots during nap time did not reveal a lack of walkable pathways or access being blocked.

Finally, it was alleged that “Current records for each child are not maintained in the facility”. LPA reviewed 12 files randomly chosen and all were complete. In addition, interviews with staff did not reveal a concern regarding files being outdated or missing information.

Based on LPA’s observations, conflicting statements and lack of clear corroborating evidence, the above allegations could not be substantiated or dismissed. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the finding is UNSUBSTANTIATED.
