On June 12, 2024, Licensing Program Analyst (LPA) Jennie Tedlos met with Director (D1), Frisha Moore to deliver the findings of the complaint investigation regarding the above allegations. LPA's observed 29 children.
LPA Tedlos conducted an investigation regarding the complaint allegations listed above. LPA toured the facility, conducted interviews with the Reporting Party (RP), Staff Members, Children enrolled at the facility and parents of children that attend or who have attended the facility. LPA also obtained pertinent information to assist with the investigation.
It was alleged that staff caused injuries to daycare child. It was reported that a child (Child 1) was seen to have scratches on their shoulder and a small bruise after attending day care. Interviews with staff revealed that if an incident happens or a teacher notices a mark that appears on a child while at school, the teachers will send an incident report to the guardian of the child. There was no indication that the injuries were caused by staff. LPA did not discover any evidence to support the allegation, and interviews did not reveal corroboration for the allegation.

It was alleged that Staff did not meet day care children's toileting needs. Interviews with staff revealed that although children may ask to use the restroom when they need, teachers are potty training and schedule potty times at certain times of the day to give the children opportunities throughout the day to use the potty. LPA did not discover any evidence to support the allegation, and interviews did not reveal corroboration for the allegation.

It was alleged that Staff did not provide incident reports to child’s authorized representative. It was alleged that incident reports were not given to the authorized representative when the scratch on the shoulder and bruise appeared. Staff state that it is best practice to do an ouch report for scrapes and bruises, but small scrapes and falls may not be reported every time it happens. Incident reports are reported to guardians through the facility's app. Record review shows that the facility was in constant communication with the Reporting Party about incidents that happened throughout the day with the Reporting Party's child. LPA did not discover any evidence to support the allegation, and interviews did not reveal corroboration for the allegation.

Based on interviews, observations, documentation, and other information gathered, there was not a preponderance of evidence to prove or negate the allegations, therefore the allegations listed above are UNSUBSTANTIATED. In the areas that were evaluated for these complaint allegations on 04/17/2024, no deficiencies were cited during today's inspection.

An exit interview was conducted with Director Moore. LPA provided Appeal Rights to D1. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

On June 12, 2024, Licensing Program Analyst (LPA) Jennie Tedlos met with Director (D1), Frisha Moore to deliver the findings of the complaint investigation regarding the above allegations. LPA's observed 29 children.
LPA Tedlos conducted an investigation regarding the complaint allegations listed above. LPA toured the facility, conducted interviews with the Reporting Party (RP), Staff Members, Children enrolled at the facility and parents of children that attend or who have attended the facility. LPA also obtained pertinent information to assist with the investigation.
It was alleged that a daycare child was left unattended. There was a concern that a child (Child 1) was left unattended resulting in Child 1 eating concerning items. Interviews with staff revealed that measures were taken to prevent Child 1 from eating items, but Child 1 would still find a way to eat the items. Interviews also revealed that a staff member would shadow Child 1 outside to make sure objects were not eaten, but Child 1 would still find items to eat. ...classroom. LPA observed Child 1 climbing on top of a bookshelf. LPA brought it to the attention of a teacher who brought the child down. LPA also observed Child 1 being given markers. Child 1 began biting off the tip of the marker and holding it in their mouth. LPA brought it to the attention of a teacher who took the piece of marker out of the child's mouth.

It was alleged that Staff did not meet child’s diapering needs resulting in diaper rash. There was a concern that Child 1 was not being changed often enough and was being changed in the incorrect diapers, leading to diaper rash. Interviews with other Parents whose children attend the facility have also expressed the same concern of their child being brought home with diaper rashes and in the incorrect diapers. Staff interviews, observation, and record review reveal that each child has their own tub of diapers at the facility. Parents bring their child's supply of diapers to the facility. Staff state that when children run out of diapers, parents are contacted to replenish the diapers. If the child is completely out of diapers, staff report that they use the facility's back up diapers.

Based on a preponderance of evidence obtained the complaint regarding the above allegations are SUBSTANTIATED.

Two Type B Deficiencies were cited on the subsequent page (LIC9099-D) of this report.

An Exit interview was conducted in which the report was reviewed and discussed with the Director. LPA provided a copy of the report and Appeal Rights to Director. A Notice of Site visit was posted by LPA and Director understands it must remain posted for 30 days.

Director Moore states that a staff training will be done regarding staff supervision. Staff will receive the training which will include the CCLD Supervision training video for Child Care Centers. Director Moore will send LPA signatures of all staff in attendance, showing they received the training.

This regulation was not met as evidenced by: LPA observed Child 1 climbing a book case and eating the tip off a marker without teacher's noticing. It was revealed that Child 1 was eating sand from the sandbox when under staff supervision. This poses a potential health, safety and personal rights risk to children in care.
