On 7/22/22 Licensing Program Analyst (LPA) Fabiola Diaz met with licensee Griselda Cruz unannounced annual inspection/1 year inspection. Present in the facility were 6 children (including 2 of licensee's own children and one infant). All individuals subject to criminal background review have obtained a criminal record clearance.

The one story home has a unfenced front yard, 3 bedrooms, 1 bathroom, garage, kitchen, living room, dining room, laundry room, and fenced backyard with a shed. On today's date licensee updated the off-limits areas in the home to be: Bedroom #2, garage, laundry room, and shed. Off-limits areas will remain inaccessible to children by closed doors and/or supervision. Licensee acknowledges that children may never enter these off-limit areas. Licensee was notified that prior to use of any off limits area, the department must be notified.

A health and safety inspection was conducted in the areas accessible to children. The house has a working telephone, fully charged fire extinguisher, smoke detector and carbon monoxide detector that meet regulations. Licensee stated there are no weapons in the home. LPA observed insect poison on a shelf in the hallway closet. Licensee explained she thought it just needed to be out of the reach of children. Licensee locked up the poison on during the inspection. Safe toys and play equipment were observed. LPA discussed and observed all the required postings.

LPA observed licensee's immunization record in the facility file. Children's roster was discussed. A fire drill log was incomplete; licensee stated that the last fire drill conducted was on November 2021. Licensee's CPR/First aid card was expired with an expiration date of 12/09/23. Mandated Reporter Training for licensee expired on 11/22/23. Licensee understands training must be complete every two years. LPA observed children's files, but observed the infant's file to be missing LIC9227 form. A technical assistance note was provided.

Based on observation, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. Licensee did not ensure to keep insect poison locked away. Licensee had it on a shelf in the hallway closet. Licensee explained she thought it just needed to be out of the reach of children.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

To improve the quality and value of the new inspection process, a survey will be sent to the email address provided. Please complete the survey and share your inspection experience. Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Appeal Rights and Notice of Site Visit were provided. Notice of Site Visit must remain posted for 30 days. Exit interview was conducted and report was reviewed with the licensee.



LPA Diaz informed licensee Griselda Cruz that this report dated 7/22/22 documents a Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Diaz informed the licensee Alma Limon to provide a copy of this licensing report dated 7/22/22 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
