Licensing Program Analyst (LPA) Kelly Ferrara conducted a complaint follow up inspection to deliver findings and met with Director Maya Patel. LPA observed there were currently 38 children in care with five staff. During the investigation, LPA obtained relevant documentation and interviewed the Licensee, Reporting Party, Director and staff.

It was alleged that staff at the facility had Child #1, Child #2, and Child #3 remove all of their clothes in order to wash off the children’s bodies. Director and staff stated the children had become dirty from mud in the outside play area. Consistent statements were made during all interviews that the children were washed off with a hose, while staff used a towel to attempt to block them from view of the remaining children. LPA learned that other children were able to see Child #1, #2, and #3 without their clothes on and some staff stated they did not agree with hosing the children off and thought they should have been cleaned in private.

Based on the evidence obtained, LPA determined that the allegation is substantiated, meaning that the preponderance of evidence standard has been met. One Type A citation was issued on the following 9099-D regarding a violation of personal rights. Exit interview was conducted. A copy of this report was given to the Director.

Director acknowledges that upon receipt of Type A citation, Director shall post and provide copies of the LIC 9099 D for parents/guardians of children in care and for parents/guardians of newly enrolled children for the next 12 months. Facility must also keep the signed LIC 9224, acknowledging receipt of LIC 9099 D in each child's file. Exit interview was conducted, appeal rights and a copy of this report was given to the Assistant Director. Notice of Site visit was provided which must remain posted for 30 days.

Licensee shall have all staff including Director watch the videos on the CCLD website (CCLD.CA.GOV) regarding Personal Rights. Licensee will come up with hypothetical scenarios that the staff will write their responses to or write a paragraph about what they learned. Documentation shall be submitted to LPA by POC due date.

LPA learned that staff had child #1,#2, and #3 undress and use a hose to wash them off when they became dirty. Other children witnessed the event. This is an immediate health and safety risk to children in care.
