At 2:55pm on 8/10/2023, Licensing Program Analyst (LPA) Matthew Gallo met with Facility Representative Abigail Newberry to deliver findings regarding the complaint that was opened on 6/15/2023. Today's census included 25 children, including 8 toddlers supervised by 2 staff and 17 preschool children supervised by 3 staff.

It was alleged that staff used inappropriate forms of punishment towards a daycare child. Throughout the investigation, LPA conducted observations, record review, and interviewed Reporting Party, staff, and parents. Through the course of staff interviews, LPA received corroborating evidence consistent with the allegation that, after having bit another child, a child in the toddler component was separated from their class and placed in a half-walled infant napping area that became locked from the inside.

The preponderance of evidence standard has been met. Therefore, the above allegation is SUBSTANTIATED.

A Type A Title 22 Deficiency has been cited on the attached LIC 9099-D. Appeal Rights and LIC9224 form were provided. An exit interview was conducted with Facility Representative Abigail Newberry, and a Notice of Site Visit posted.

At 2:55pm on 8/10/2023, Licensing Program Analyst (LPA) Matthew Gallo met with Facility Representative Abigail Newberry to deliver findings regarding the complaint that was opened on 6/15/2023. Today's census included 25 children, including 8 toddlers supervised by 2 staff and 17 preschool children supervised by 3 staff.

It was alleged that, due to lack of supervision, a daycare child had bitten another daycare child while in care. Throughout the investigation, LPA conducted observations, record review, and interviewed Reporting Party, staff, and parents. Information gathered from the these sources did not provide sufficient evidence to either support or dimiss the above allegation. Therefore, the finding for the above allegation is UNSUBSTANTIATED, meaning that although the the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegations occurred.

Exit interview was conducted with Abigail Newberry, during which this report was reviewed. Appeal Rights and Notice of Site Visit were provided, the latter of which must be posted for 30 days.

Acting Director will provide one-on-one training with staff regarding personal rights of children in care, and send LPA Gallo confirmations signed by each staff member that this training has occured by the POC due date.

This requirement was not met as evidenced by consistent statements during staff interviews establishing that a child who had bitten another child was separated from their class and placed in a half-walled infant napping area that became locked. This posed an immediate health and safety risk to children in care.
