At 10:00 a.m. on Tuesday, February 7th, 2023, Licensing Program Analyst (LPA) Karyn Guerra met with Assistant, Andrea Robinson, for the purpose of an unannounced, required - 1 year inspection. LPA observed a census of 2 infant children. Licensee was at an appointment during inspection and arrived at 11:00 a.m. Facility hours of operation are from 6:00 a.m. - 9:00 p.m., 7 days a week. Off limit areas consist of entire second floor, bedroom 2, bedroom 3, pool area, and garage. Assistant understands that child care children must not enter the off limits areas of the home.

All individuals subject to criminal background review have obtained a criminal record clearance. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

A health and safety inspection was conducted in all areas accessible to children. THe main play room is currently under construction with a floor replacement. LPA observed the required postings, a working phone, 2A10BC fire extinguisher, and functioning smoke and carbon monoxide detectors. Assistant stated that there are no weapons nor poisons in the home. Toxic and hazardous items were appropriately stored, inaccessible to children. Fireplace is appropriately barricaded to prevent access by children. Fire Drills have been conducted and documented. There is a fenced pool in an off limits area of the backyard. Gate surrounding the pool swings away from the body of water, however, it does not self latch. Assistant stated that recent storms have caused the damage to the previously self latching gate. Assistant stated that gate remains locked.

LPA reviewed staff and children's files. CPR for the Licensee expires October, 2024. Mandated reporter training was verified for Licensee. Licensee is reminded that assistants shall have mandated reporter training, and CPR certification is required when left alone with children. LPA observed emergency identification and consent for emergency medical treatment. Assistant was reminded that parent's rights notification and notification of additional children in care shall be signed by authorized representatives, and immunization records shall be maintained for all pre-kindergarten children.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage athttps://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Applicant was reminded to document 15 minute checks of napping infants.

This provider is not currently providing Incidental Medical Services IMS services to children in care. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on observation and interview, the licensee did not comply with the section cited above in as the gate on the pool is not self latching, which poses/posed a potential health, safety or personal rights risk to persons in care.
