On Monday, December 4, 2023, Licensing Program Analysts (LPAs) Mandie Goodwin and Katrina Owens met with Director, Kaneesha Singh for the purpose of a complaint inspection regarding the above allegations and to deliver findings. Upon arrival, LPAs observed 8 infant children supervised by 2 staff members.

During the course of the investigation, LPA conducted interviews, made observations, and collected documentation. During 3 separate dates LPA observed staff using swings to assist putting infants to sleep, however once asleep the infants were then moved to a crib or cot. Interviews confirmed that infants are in swings to start nap, but are then moved to their cots or crib. LPA received conflicting information on the length of time that infants are asleep in the swings before being moved to their safe sleeping environment, but did not find a preponderance of evidence that children sleep in swings. Interviews did not reveal additional concerns with infant sleeping conditions. LPA made observations in the classroom and conducted a test of the handwashing sink and cabinet. Continued on 9099-C

LPA observed the sink to be operational and in sanitary condition. LPA tested the cabinet under the sink and observed that it is in safe condition. Director stated that the cabinet door was off and they had a handyman come and replace it. While the door was off there was nothing in the cabinet that could be a risk to children. Interviews stated that staff sometimes use low feeding chairs (high chairs) outside for infants who aren’t yet able to walk so that the infants can go outside, but do not eat things off the ground. Interviews stated that they put toys on the trays or children watch the cars go by and that a staff member stays next to the feeding chair. Snack is sometimes served outside as well, and the feeding chairs are used for snack. Interviews also stated that other times a staff member stays inside with the children who are non-mobile, while the mobile infants play outside. Additional interviews conducted did not reveal a concern that high chairs are used to restrain. The use of high chairs to sit outside with the class and teacher support nearby and the additional option to go inside is not a violation of personal rights. Interviews consistently stated that changing table is always sanitized between children. Facility uses a sanitizing spray to wipe down the changing area. Additional interviews did not express a concern with changing time. LPA made observations of a diaper change and observed staff using sanitizer at that time. Observations did not reveal evidence of blankets used in cribs during sleep. Interviews revealed that children on cots have blankets, but the children that are under 12 months and in cribs do not have blankets in the crib with them. Additional interviews revealed that when brightwheel photos are taken there don’t appear to be blankets or anything else in the crib with the infants. For food service, it was alleged in specific that children are not provided fruits and veggies. Interviews revealed that infants are provided either food from home or food that the school provides. LPA reviewed documentation of the brightwheel app as well as a facility menu which shows fruits, vegetables, and other components that are recommended for the age group. LPAs also observed fruits being served on visits to facility. Although the alleged violations may have happened or are valid, the preponderance of evidence standard has not been met to fully prove or disprove that they did or did not occur, therefore, they are unsubstantiated. An exit interview was conducted and a notice of site visit provided. Notice of site visit to stay posted for 30 days for parental review. Failure to comply with posting requirements can result in a $100 penalty.
