32 | It was alleged staff allows an undocumented child to be enrolled. Throughout the course of the investigation, LPA conducted interviews, made observations, and reviewed records. During interviews, it was revealed on August 15, 2025, the assistant director from another facility assisted with supervising children in the toddler option classroom and infant classroom. During this time, the assistant director brought her own child into the classroom. It was revealed during interviews that the child has been brought into classrooms on other occasions. LPA made observations of camera footage. LPA observed the child in question present in the classroom as verified by the facility’s director. LPA reviewed facility records and did not see any documentation or records on file for the child in question.
Based on the information gathered the department has found that the allegations uncleared adult was present with the day care children and staff allows an undocumented child to be enrolled to be SUBSTANTIATED: meaning that the allegation is valid because the preponderance of the evidence standard has been met.
As a result of the substantiated allegations, deficiencies will be issued on the attached LIC9099-D for violation of CCR 101170(e)(2) and CCR 101221(a). An immediate Civil Penalty of $100 has been assessed due to violation of the Child Care Regulation – Criminal Record Clearance 101170(e)(2).
LPA Williams informed the facility owner that upon receipt, the facility owner shall post and provide copies of this licensing report dated 10/29/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted with facility owner, Ginette Stephens. A copy of this report was provided. The facility representative was provided with a copy of their Appeal Rights (LIC9058) and the facility representative’s signature on this form acknowledges receipt of these rights. A notice of site visit was given and must remain posted for 30 days. |
