32 | LPA observed one out of two children had a signed consent letter from their parent. LPA reviewed children’s files and facility rosters to verify the date of births of children. LPA verified the two children present in the preschool classroom are under the age of two years old. The facility’s preschool license states the facility is licensed to serve children from age two years to entry into kindergarten. Based on the information gathered LPA verified staff are operating beyond the terms and conditions of the license.
It was alleged staff speak inappropriately to children. Throughout the course of the investigation, LPA conducted interviews and made observations. During interviews, four out of six staff stated there was a staff member that would yell at children and use a harsh tone. Four out of six staff stated the individual is no longer employed at the facility for this reason. Four out of six staff stated there currently are no concerns with how current staff speak to children. LPA observed staff speaking to children in a soft one. LPA did not observe any staff members yelling at the children or speaking harshly.
Based on the information gathered the department has found that the allegations staff are operating beyond the terms and conditions of the license and staff speak inappropriately to children to be SUBSTANTIATED: meaning that the allegation is valid because the preponderance of the evidence standard has been met. As a result of the substantiated allegations, deficiencies will be issued on the attached LIC9099-D for violation of CCR 101161(a) and CCR 101223(a)(1).
LPA Williams informed the director that upon receipt, director shall post and provide copies of this licensing report dated 10/29/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or other written statement, must be placed in the child's file for verification.

The facility representative was provided with a copy of their Appeal Rights (LIC9058) and the facility representative’s signature on this form acknowledges receipt of these rights. A notice of site visit was given and must remain posted for 30 days |
