Licensing Program Analyst (LPA) Andrea Cortez met with Licensee Briana Esquivel for the purpose of conducting an unannounced complaint investigation to deliver findings regarding the above allegations. The purpose of today's inspection was explained.

It was alleged that Staff #1 (S1) was observed raising their voice at children and physically guiding or grabbing children by the shoulders in a forceful manner while directing them to sit or stop playing. LPA Cortez interviewed parents who did not report witnessing S1 talking with the children in such tone and rough manner. Interviews with children did not reveal S1 using a loud tone or being handled in a rough manner. However, interviews with the two other staff members indicated that S1’s tone of voice was concerning and made them feel uncomfortable.
LPA reviewed video footage submitted by the licensee related to the allegations. The video showed S1 using a consistently loud/stern voice with the children and guiding one child by the forearm/wrist. However, there were no signs or indication of children in distressed.

Based on the information obtained, there was insufficient evidence to support the above allegations. Although the allegation may be true or may have happened, there is not a preponderance of evidence to prove the allegations; therefore, the allegations are unsubstantiated. Exit interview was conducted and report was reviewed with RD. Appeal rights were provided. Notice of site visit was given and must remain posted for 30 days.
